MINUTES Page 6
City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 17, 2008
Petroleum Storage Act (APSA) and an Agreement with Cal EPA Accepting Delegation
and Agreeing to Implement the APSA (authorizes application for and acceptance of
grant funds from the Environmental Protection Trust Fund, to allow City oversight of
the APSA program). (3132)
G. Resolution No. 2008-028, Resolution Authorizing the City Manager to Enter into an
Agreement with AT&T, a Delaware Limited Liability Corporation, for Construction of
Underground Street Light Conduits on East 14th Street, Project No. 210-38-172
(provides for the undergrounding of joint-use utilities on East 14th Street from 150th
Avenue to the southern City limits). (1447/3041)
9. ITEMS REMOVED FROM CONSENT CALENDAR
Public comments are limited to 3 minutes per speaker per item, subject to adjustment by the
Mayor.
8.C. Matter of an Addendum to the Exclusive Negotiating Agreement (ENA) Between the
City of San Leandro, the Redevelopment Agency of the City of San Leandro, San
Francisco Bay Area Rapid Transit District (BART) and Westlake Development
Partners, LLC (addresses civic engagement process on the transit-oriented, mixed-use
development located on multiple parcels adjacent to the San Leandro BART Station).
Public Comments on Item 8.C.:
Lou Filipovich, San Leandro resident, addressed the City Council, making
suggestions regarding the format and presentation of the City and Redevelopment
Agency budgets to better understand the issues of infrastructure and replacement/repair.
End of Public Comments on Item 8.C.
Mr. Jermanis indicated that BART's legal staff have made suggestions for minor
changes to the proposed language, as well as requesting that it be adopted as an
amendment, rather than an addendum, to the ENA.
Ms. Williams stated that the resolution would be amended to reflect the change to the
instrument to be adopted from an addendum to an amendment, and that this would not
substantively change the intent of the action. She commented that she feels this is an
improvement to the process.
• Resolution No. 2008-029, Resolution of the City Council of the City of San
Leandro Amending the Exclusive Negotiating Agreement (ENA), Approved by
Resolution No. 2008-014, Between the City of San Leandro, San Leandro
Redevelopment Agency, San Francisco Bay Area Rapid Transit District (BART)
and Westlake Development Partners, LLC Related to Proposed Language
