IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO 2008-033 (3133) <br />RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND CALLING FOR BIDS <br />ON THE DOWNTOWN LIGHTING AND PEDESTRIAN IMPROVEMENT PROJECT, <br />PROJECT NO. 07-961-83-054 <br />RECITALS <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33421 <br />authorizes a redevelopment agency to cause the installation of public improvements necessary in <br />the project area for carrying out the redevelopment plan; and <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the value of the land and the cost of the construction of any building, facility, <br />structure, or other improvement which is publicly owned either within or without the project area <br />if it determines all of the following: <br />The buildings, facilities, structures, or other improvements are of benefit to the <br />project area or the immediate neighborhood in which the project is located; and <br />2. That no other reasonable means of financing the buildings, facilities, structures, or <br />other improvements, are available to the community; and <br />That the payment of funds for the acquisition of land or the cost of buildings, <br />facilities, structures, or other improvements will assist in the elimination of one or <br />more blighting conditions inside the project area; and <br />4. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") is <br />engaged in the Downtown Lighting and Pedestrian Improvements project in the City's <br />downtown area, including the Plaza Redevelopment Project Area ("Project Area"), which is <br />designed in part to draw people into that area; and <br />WHEREAS, no other reasonable means of financing the installation of the <br />Improvements, is available to the community in that the only other possible source of funding is <br />through the use of the City's General Fund and that is pledged for the provision of essential City <br />services for the residents of the City such as police and fire services; and <br />WHEREAS, the installation of the Improvements, will assist in the elimination of one or <br />more blighting conditions in the Project Area by furthering the implementation of the Downtown <br />Lighting and Pedestrian Improvements project, which will attract patrons to the City's downtown <br />area, including the Project Area, in turn increasing and strengthening existing uses in the Project <br />
