3. The City hereby authorizes and directs the City Manager, or his designee, to execute in <br />the "Name of the City" the application, the Standard Agreement, and all other documents required <br />by HCD for participation in the Infill Infrastructure Grant Program, and to execute any <br />amendments thereto. Furthermore, the City hereby authorizes the City Manager, or his designee, to <br />negotiate grant terms, execute, modify, amend and extend agreements, allocate revenue, make <br />expenditures, and take all other actions with respect to the Infill Infrastructure Grant Program in <br />accordance with this resolution and its basic purposes. <br />4. In the event that additional funds are received for these projects, the City Manager or <br />his designee is hereby authorized to accept and allocate the same for the purposes described above. <br />5. The City has independently reviewed and considered this environmental <br />determination, and the City finds and determines, based on the information in the staff report <br />accompanying this Resolution, that this action complies with CEQA because this action on the part <br />of the City is covered by the Environmental Impact Report for the TOD Strategy, certified on <br />September 4, 2007. <br />Introduced by Councilmember and passed and adopted this <br />21 S` day of April, 2008 by the following called vote: <br />Members of the City Council: <br />AYES: <br />NOES: <br />ABSENT: <br />ATTEST: <br />Marian Handa, City Clerk <br />1081954.1 <br />
