CONDITIONS OF APPROVAL <br />PLN2007-00057 Business Center Place, Lots 6 and 7 <br />Merced Street Property, LLC (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through D, referenced in the approval letter <br />dated January 22, 2008, except as hereinafter modified. (Copies of Exhibits are on file <br />iii the Community Development Department, 835 East 14th Street, San Leandro, <br />California). <br />Exhibit A -Site Plan (Sheet A-1) <br />Exhibit B - Building A Exterior Elevations (Sheet A-2) <br />Exhibit C Building B Exterior Elevations (Sheet A-3) <br />Exhibit D -Colored Elevations, Colors and Materials Board <br />B. The applicant and/or property owner shall be responsible for assuring that any successor in <br />interest who assumes responsibility for this zoning approval is informed of its terms and <br />conditions. <br />C. Construction shall commence within one (1) year following Zoning Enforcement <br />Official approval of the Site Plan Review and shall be substantially completed one year <br />after commencement of construction. For the purpose of compliance with this condition, <br />commencement of construction shall be defined as the paving of the site for the vehicle <br />storage facility. <br />lI. PERMITTED USE <br />A. This site plan review approval allows for the construction of two industrial buildings <br />totaling 64,660 square feet (Building A - 54,100 square feet and Building B - 10,560 <br />square feet) located at Business Center Place, Lots 6 and 7, Alameda County Assessor's <br />Parcel Numbers 79A-591-13 and -14. Any additional usage or change to the specified <br />site plan review exhibits shall be submitted in writing to the Zoning Enforcement <br />Official for review, who may approve the request or direct the matter to the Board of <br />Zoning Adjustments. <br />III. FIRE DEPARTMENT <br />A. Prior to issuance of occupancy, automatic sprinklers shall be provided throughout the <br />buildings as required by the San Leandro Fire Code. If there are over 100 sprinklers, the <br />system shall be monitored by UL listed central station. <br />B. Prior to issuance of a building permit, the fire flow for the site shall comply with <br />appendix III-A of the CFC. Provide a letter from EBM[_ID stating what the available fire <br />flow is at the site. A copy of the letter shall be submitted to our office. <br />C. Prior to vertical construction or combustible storage on site, applicant shall provide <br />additional fire hydrants in accordance with CFC appendix III-B. <br />Agreement to Conditions of Approval January 22, ?008 <br />PL1~3007-00057 Page 3 of 9 <br />
