IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2008-056 (1123) <br />RESOLUTION SUPPORTING PROPOSITION 99, <br />THE HOMEOWNERS PROTECTION ACT <br />WHEREAS, in June of 2005 the U.S. Supreme Court ruled in Kelo v. City of New London <br />that government could acquire a private home through eminent domain and transfer the property to <br />a private developer; and <br />WHEREAS, since that U.S. Supreme Court decision, more than forty (40) states have <br />reformed their eminent domain laws; and <br />WHEREAS, California has failed to place a prohibition on the use of eminent domain to <br />take homes for private development; and <br />WHEREAS, Proposition 99 on the June 2008 ballot, will prohibit governments from using <br />eminent domain to acquire an owner-occupied home for transfer to another private party; and <br />WHEREAS, the protections in Proposition 99 directly address the issues in the Kelo <br />decision and the measure does not contain any unrelated provisions that will result in unintended, <br />harmful consequences for California; and <br />WHEREAS, the YES on Proposition 99 campaign is supported by a broad-based coalition, <br />including the League of California Cities, California State Association of Counties, League of <br />California Homeowners, California League of Conservation Voters, California Alliance for Retired <br />Americans and other leading state and local associations who support Proposition 99. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE to <br />support Proposition 99. <br />Introduced by Councilmember Grant and passed and adopted this 19th day of May, 2008 by <br />the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Grant, Gregory, Prola, Souza, Starosciak, Stephens; <br />Mayor Santos (7) <br />NOES: None (~) <br />ABSENT: None (~) <br />ATTEST: ~ ,(,P~(/V1, <br />Marian Handa, City Clerk <br />
