IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2008-057 (1123) <br />RESOLUTION OPPOSING PROPOSITION 98, <br />THE CALIFORNIA PROPERTY OWNERS AND FARMLAND PROTECTION ACT <br />WHEREAS, a constitutional amendment ballot measure will appear on California's June <br />2008 ballot as Proposition 98; and <br />WHEREAS, Proposition 98 appears to address eminent domain, but in fact contains <br />language which will eliminate rent control, threaten development of public water projects, and <br />limit local land use planning and environmental efforts in California; and <br />WHEREAS, provisions in the initiative will preclude the use of eminent domain to acquire <br />land or water to develop public water projects needed to provide a reliable and safe supply of water <br />to California; and <br />WHEREAS, language in the initiative will also prohibit the passage of regulations, <br />ordinances, land use and other zoning laws that will enable local governments to plan and protect <br />communities; and <br />WHEREAS, leading environmental groups warn of provisions that would impair the <br />ability of local governments to enact environmental protections against such issues as greenhouse <br />emissions, the protection of coastal areas, and the preservation of open space; and <br />WHEREAS, the NO on Proposition 98 campaign is supported by the League of California <br />Cities, California State Association of Counties, League of California Homeowners, California <br />League of Conservation Voters, California Alliance for Retired Americans and other leading state <br />and local associations who oppose Proposition 98. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE to <br />oppose Proposition 98. <br />Introduced by Councilmember Grant and passed and adopted this 19t" day of May, 2008 by <br />the following called vote: <br />Members of the Council: <br />AYES: Councilmembers Grant, Gregory, Prola, Souza, Starosciak, Stephens; <br />Mayor Santos (7) <br />NOES: None (0) <br />ABSENT: None (~) <br />ATTEST: 1 /I.(~ <br />Marian Handa, City Clerk <br />
