MINUTES <br />Page 3 <br />City of San Leandro Ciry Council and San Leandro Redevelopment Agency Joint Meeting-May 5, 2008 <br />A. Matter of Proposed Adjustments to City Fees and Service Charges and Taxes for Fiscal <br />Year 2008-09 (approves proposed adjustments to City user fees and service charges for <br />Fiscal Year 2008-09 as well as adjustments to the Emergency Medical Services Tax and <br />Business License Tax, in accordance with the San Leandro Municipal Code). <br />This being the time and place for the Public Hearing on the above matter, City Manager <br />Jermanis gave an overview of the item and introduced Assistant City Manager Steve <br />Hollister and Budget and Compliance Manager Mary Ann Perini. <br />Mr. Hollister and Ms. Perini gave a short PowerPoint presentation, describing the <br />proposed increases to various fees and service charges, as well as increases to the <br />Emergency Medical Services (EMS) Tax and Business License Tax. <br />The Hearing was then opened to the public. <br />Lou Filipovich, San Leandro resident, addressed the City Council, commenting that <br />businesses are essentially tax collecting agencies, and they pass the cost of taxes, rates <br />and fees on to their customers. Mr. Filipovich stated that we can no longer have <br />taxpayers subsidizing taxpayers to fund local government, and the public should be <br />consulted as to where budget cuts should be made before any taxes or fees are increased. <br />Paul Vargas, San Leandro resident, addressed the City Council, commenting on the <br />recent California First Circuit Court of Appeals' ruling that Union City's 911 fee is <br />illegal because it was not passed by a vote of the people. Mr. Vargas stated that San <br />Leandro's 911 fee was not brought before the voters, and therefore San Leandro must <br />refund any illegally collected fees and receive voter approval before any future increases <br />can be made. <br />Al Smith, San Leandro resident, addressed the City Council, commenting that as a <br />small apartment owner, he opposes tax and fee increases as he must pass these increases <br />on to his tenants. <br />There being no further comments from the public, and without objection, the Public <br />Hearing was closed. <br />Vice Mayor Grant suggested that the City Council delay action on the approval of the <br />911 fee, which is Item B.E. on tonight's agenda, until it has had a chance to discuss the <br />fee further. <br />Resolution No. 2008-045, Resolution Amending Title 6, Chapter 4 of the San <br />Leandro Administrative Code Relating to Fees and Charges for Services Provided <br />by City Departments (allows for annual increase in fees charged for services by <br />City departments, to be effective July 1, 2008). (2318) <br />A motion was made to adopt the resolution, with the exception of the increases to <br />the Emergency Communication System Access Fee (911 Fee). <br />
