CONDITIONS OF APPROVAL <br />PLN2007-00049 -1220 147t~' Avenue <br />Elpidio Ramos (applicant) and Juan Manuel Medina (property owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant/property owner shall comply with Exhibits A through C, attached to the staff <br />report dated November 6, 2007, except as hereinafter modified. (Exhibits are on file in the <br />City of San Leandro Community Development Deparhnent, 835 East 14th Street, San <br />Leandro, California, 94577). <br />Exhibit A -Existing Floor Plan <br />Exhibit B -Plot Plan & New Floor Plan <br />Exhibit C -Elevations <br />B. The applicant/property owner shall be responsible for assuring that any successor in interest <br />who assumes responsibility for this zoning approval is informed of its terms and conditions. <br />C. Construction shall commence within one (1) year following Zoning Enforcement Official <br />approval of the Major View Preservation/Site Plan Review and shall be substantially <br />completed one year after commencement of construction. For the purpose of compliance <br />with this condition, commencement of construction shall be defined as the construction of <br />a substantial portion of the building foundation structures. <br />D. This Major Site Plan Review approval permits the construction of a one-story addition to <br />the rear of the existing one-story dwelling consisting of approximately 1,505 square feet <br />and resulting in a new total livable area of 2,249 square feet, at 1220 147t~' Avenue, <br />Alameda County Assessor's Parcel Number 77D-1467-36. <br />E. The subject residence shall be limited to single-family occupancy, only, unless the City <br />grants approval of a permit for any other unit. For the purposes of this condition, <br />installation of any appliances for cooking, including, but not limited to a stove, hot plate or <br />microwave oven, in any room other than the individual kitchen in the existing dwelling <br />unit within the single-family home, shall be deemed the creation of an additional kitchen <br />and therefore creation of an additional dwelling unit. Specifically, bedrooms or any room <br />other than the designated kitchen in the home on the property shall not have any other <br />kitchen and shall not be acknowledged as a separate dwelling w7it at the subject property. <br />F. Pursuant to Zoning Code Section 2-520 (Maximum Dwelling Unit Occupancy), a zoning <br />pernlit shall be required for occupancy of a dwelling unit by more than ten (10) persons <br />eighteen (18) years or older. <br />Agreement to Conditions November 6, 2007 <br />PLN2007-0009 Page 3 of 4 <br />
