The applicant and/or property owner shall comply with Exhibits A, B & C dated March 7, <br />2008, except as hereinafter modified. (Exhibits are on file at the City of San Leandro <br />Development Services Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A -Site Plan <br />Exhibit B -Outdoor Play Area <br />Exhibit C -Fence Design <br />B. The applicant and/or property owner shall be responsible for assuring that any successor in <br />interest who assumes responsibility for this zoning approval is informed of its terms and <br />conditions. <br />C. Approval of this Minor Modification allows the applicant/property owner to re-locate from <br />the Dutton Avenue frontage to the Dowling Boulevard frontage, the outdoor play area <br />associated with the day care center approved by CU-98-3. <br />D. With the exception of the existing wood fence separating the project site and the adjacent <br />residence, a new wrought-iron fence shall be installed around the new play area and shall <br />remain in substantial compliance with the approved design and color (black) indicated on <br />Exhibit C. Any change to the fence design or location shall be subject to the review and <br />approval of the Community Development Director. <br />E. Use of the outdoor play area shall not occur before 9:00 A.M. and shall cease by no later <br />than 4:30 P.M., Monday thru Friday. The outdoor play area shall not be used on the <br />weekends. <br />F. With the exception of the re-location of the play area to the Dowling Boulevard frontage, <br />all previous conditions of approval for CU-98-3 shall remain in full effect. <br />II. GENERAL CONDITIONS <br />A. The site shall be well maintained and shall be kept free of litter, debris and weeds. <br />B. The play area and associated equipment shall be kept in a good, clean, sound condition at all <br />times; any damage shall be promptly repaired. <br />C. Any graffiti shall be removed from the building walls, fences or any other outdoor play <br />equipment, in a timely matu~er. <br />Agreement to Conditions March 7, 2008 <br />PLN2008-00006 Page 3 of 4 <br />
