IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2008- RESOLUTION ACCEPTING THE ENGINEER'S REPORT FOR FISCAL YEAR 2008-09 FOR THE HERON BAY MAINTENANCE ASSESSMENT DISTRICT, ASSESSMENT DISTRICT NO. 96-3 Recitals WHEREAS, the City Council, pursuant to the provisions of the San Leandro Municipal Code, Chapter 5, Title II (hereafter referred to as the "Code") did order the Engineer, NBS Government Finance Group, to prepare and file a report in accordance with the Code, in connection with the proposed levy and collection of assessments for the district known and designated as the Heron Bay Maintenance Assessment District (Assessment District No. 96-3), for the fiscal year commencing July 1, 2008, and ending June 30, 2009; and WHEREAS, the Engineer has prepared and filed with the City Clerk of the City of San Leandro and the City Clerk has presented to the City Council such report entitled "Annual Engineer's Report, Heron Bay Maintenance Assessment District, Assessment District No. 96-3, Fiscal Year 2008-09 " (hereafter referred to as the "Report", attached hereto and made a part of); and WHEREAS, the City Council has carefully examined and reviewed the Report as presented, and is satisfied with each and all of the items and documents as set forth therein, and finds that the levy has been spread in accordance with the special benefits received from the improvements, operation, maintenance, and services to be performed, as set forth in said Report; NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Council hereby approves the Report as filed.
