taxes pursuant to Section 33670 and repayment of debt with tax increment shall be extended by one (1) year from the current date of July 19, 2044. The Plan Amendment, constituting the Second Amendment to the West San Leandro - MacArthur Boulevard Redevelopment Project Area, consists of the following additional and/or replacement text as follows: A) The replacement within Section 700 of the sentence beginning "The Plan shall remain..." with the following sentence: "The Plan shall remain effective for a period of 31 years from the date of the adoption of the Plan." B) The replacement within Section 405 of the sentence beginning "The Agency shall not use..." with the following sentence: "Pursuant to Section 33333.2 of the Health and Safety Code, the Agency shall not use tax increment funds to repay indebtedness more than 46 years from the date of adoption of the Plan." The Plan Amendment is hereby approved and adopted. The Plan, as amended by the Plan Amendment, is incorporated in this ordinance by reference and is hereby designated as the official redevelopment plan for the Project Area. Section 2. The City Clerk is hereby directed to send a certified copy of this Ordinance to the Agency. Section 3. This ordinance shall be in full force and effect thirty (30) days after its adoption. Section 4. The City Clerk is hereby ordered and directed to cause this Ordinance to be published once in the Daily Review, a newspaper of general circulation, published and circulated in the City of San Leandro. Section 5. If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and this City Council hereby declares that it would have passed the remainder of this Ordinance if such invalid portion thereof had been deleted. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of San Leandro hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
