EXHIBIT F , <br />FEDERAL PROVISIONS <br />1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded by fiscal <br />assistance from another governmental entity, Participant shall comply with all applicable rules and regulations <br />to which City is bound by the terms of such fiscal assistance program. In particular, Participant agrees to <br />comply with all applicable provisions of the Housing and Community Development Act of 1974 (Public Law <br />93-383) and regulations promulgated pursuant thereto. Participant also agrees to carry out activities in <br />compliance with the requirements of Subpart K of 24 CFR 570. <br />2. RECORDS. Records must be kept accurate and up to date. Participant's records shall be made <br />available for review by the City, HUD or the designee. Participant shall be responsible to maintain, for not <br />less than four (4) years after completion of this Agreement, all records pertaining to this Agreement, including <br />subcontracts and expenditures, antl all other financial and property records. <br />3, AUDITS AND INSPECTIONS. <br />A. Participant shall at any time during normal business hours and as often as the City, HUD and <br />the Comptroller General of the United States may deem necessary, make available to their representatives for <br />examination all of Participant's records with respect to all matters covered by this Agreement and shall permit <br />these representatives to audit, examine and make excerpts or transcripts from such records, and to make <br />audits of all documents and conditions relating to this Agreement. All costs are subject to the eligibility <br />requirements of HUD. <br />B, Participant shall permit antl facilitate observation antl inspection of the work and records at <br />Participant's principal office and job site by City, its employees and public authorities during reasonable <br />business hours, <br />4. CONFLICT OF INTEREST. <br />A, Participant certifies that no member of, or delegate to the Congress of the United States shall <br />be permitted to share, or take part in this Agreement or in any benefit arising therefrom. <br />B. Participant certifies that no member, officer, or employee of the City of San Leandro, or its <br />designees or agents, no member of the San Leandro City Council, and no other public official of the City of <br />San Leandro who exercises any functions or responsibilities with respect to the Community Development <br />Block Grant (CDBG) Program during its tenure or for one year thereafter, shall have any interest, direct or <br />indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in connection with <br />this Agreement. <br />C. Participant hereby certifies that no one who has any financial interest in or receives <br />compensation for services by Participant's corporation or agency is related by blood or marriage within the <br />Fiscal Year OS-09 F-1 <br />
