NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN <br />as follows: <br />Section 1. Findings. <br />The City Council of the City of San Leandro, after consideration of all matters raised <br />prior to and in the course of the public hearing conducted this date pursuant to law, does hereby <br />find as follows: <br />A. The City Council hereby finds that for the following reasons there continues to be <br />an immediate threat to the public peace, health, safety and welfare of its citizens: <br />1) Current development patterns along the East 14th Street South Area <br />present short- and long-term obstacles to the goal of the City to achieve awell-balanced and <br />economically vital transit_oriented mixed-use district. <br />2) The proliferation of undesirable uses and improvements along the East <br />14`h Street South Area during the time prior to the amendment of the City's General Plan, and <br />prior to completion of a comprehensive study leading to development and adoption of a <br />Development Strategy for development on the East 14th Street South Area, will impair or <br />preclude the City from achieving its goal of fostering a vital transit-oriented, mixed use district. <br />B. For the reasons set forth above and in the recitals of this Ordinance, the City <br />Council further finds that the approval, construction, or realization of development proposals <br />within the East 14th Street South Area that: <br />1) involve a change in use including, but not limited to, substitution of one <br />permitted use with another permitted use in the applicable zoning district; or <br />2) do not meet parking requirements as defined in the Zoning Code; or <br />3) intensify existing uses that may result in increases in noise, traffic, ,the <br />number of employees, or other similar impacts; or <br />4) establish, increase, or change business hours beyond the period of 7 am to <br />10 pm, would result in the threat set forth above to the public peace, health, safety and <br />welfare of its citizens if not subject to the discretionary review procedures set forth <br />below. <br />C. For the reasons set forth above and in the recitals of this Ordinance, the City <br />Council further finds that requiring discretionary approval for projects that involve changes in <br />use, or which require site plan review, or do not provide sufficient on-site parking, or intensify <br />existing uses, or change business hours, is necessary to protect the public health, safety, and <br />welfare, until such time as the City may amend its General Plan, and is able to study and adopt a <br />Development Strategy for the East 14th Street South Area. <br />Section 2. Scope. <br />A. All development proposals that involve a change in use, do not provide sufficient <br />on-site parking, intensify existing uses, or that involve business hours beyond the period of 7 am <br />
