IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2002- 0 6 (10 9 2 ) AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF SAN LEANDRO TO PROVIDE 2.5% AT 55 SUPPLEMENTAL FORMULA FOR LOCAL, MISCELLANEOUS MEMBERS The City Council of the City of San Leandro does ORDAIN as follows: Section L An Amendment to the contract between the City Council of the City of San Leandro and the Board of Administration of the California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked Exhibit, and by such reference made a part hereof as though herein set out in full. Section 2. The City Manager of the City of San Leandro is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said City. Section 3. This ordinance shall be effective thirty (30) days after adoption, pursuant to §1-1-345 of the San Leandro Municipal Code, and shall take effect on July 1, 2002, as set forth in particular provisions of the law prescribing the manner of its passage and adoption. This ordinance implen-ents the provisions of labor contracts negotiated in good faith and entered into between the City and its employees' bargaining units. Said labor contract requires that the agreement between the California Public Employees' Retirement System and the City be effective July 1, 2002. Failure to provide for an effective date of July 1, 2002, would constitute a breach of the labor agreements and subject the City to uncertain liabilities.
