IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2002- 0 6 (10 9 2 ) <br />AN ORDINANCE AUTHORIZING AN <br />AMENDMENT TO THE CONTRACT <br />BETWEEN THE BOARD OF ADMINISTRATION OF THE <br />CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE <br />CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />TO PROVIDE 2.5% AT 55 SUPPLEMENTAL FORMULA FOR <br />LOCAL, MISCELLANEOUS MEMBERS <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section L An Amendment to the contract between the City Council of the City of San <br />Leandro and the Board of Administration of the California Public Employees' Retirement System <br />is hereby authorized, a copy of said amendment being attached hereto, marked Exhibit, and by <br />such reference made a part hereof as though herein set out in full. <br />Section 2. The City Manager of the City of San Leandro is hereby authorized, <br />empowered, and directed to execute said amendment for and on behalf of said City. <br />Section 3. This ordinance shall be effective thirty (30) days after adoption, pursuant to <br />§1-1-345 of the San Leandro Municipal Code, and shall take effect on July 1, 2002, as set forth in <br />particular provisions of the law prescribing the manner of its passage and adoption. This <br />ordinance implen-ents the provisions of labor contracts negotiated in good faith and entered into <br />between the City and its employees' bargaining units. Said labor contract requires that the <br />agreement between the California Public Employees' Retirement System and the City be effective <br />July 1, 2002. Failure to provide for an effective date of July 1, 2002, would constitute a breach of <br />the labor agreements and subject the City to uncertain liabilities. <br />
