~+ i a r <br />Section 3-3-395: FUMIGATION AND THERMAL INSECTICIDAL FOGGING. <br />Section 3-3-395 is hereby deleted. <br />Section 3-3-396: WEATHER PROTECTION. Subsection 4. is hereby added to Section 8003.1.14 <br />to read as follows: <br />4. The area of the overhead shelter shall not exceed 3,000 square feet. <br />ARTICLE 4. HAZARDOUS MATERIALS, COMMUNITY RIGHT TO KNOW <br />Section 3-3-405: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW <br />- ENFORCEMENT. The City of San Leandro Fire Department is hereby designated as the agency of <br />the City responsible for the administration and enforcement of Chapter 6.95, Division 20 of the <br />California Health and Safety Cade. <br />Section 3-3-410: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW <br />- FEES. Pursuant to Chapter 695, Division 20 of the California Health and Safety Code, and <br />specifically California Health and Safety Code Section 25513, a schedule of fees shall be imposed by <br />resolution of the City Council. <br />Section 3-3-415: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW <br />- VIOLATIONS AND PENALTIES. The violations and penalties as set forth in Chapter 6.95, <br />Division 20 of the California Health and Safety Code are hereby specifically adopted." <br />Section 3. Severability. <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />Ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it <br />would have passed each section, subsection, subdivision, paragraph, sentence, clause phrase of <br />the Ordinance irrespective of the fact that one or more of them would be declared <br />unconstitutional or invalid. To this end, the provisions of the Ordinance are declared to be <br />severable. <br />Section 4. Effective Date and Publication. <br />This ordinance shall take effect on November 1, 2002 and the title thereof shall be published <br />once prior to adoption. <br />io <br />
