Subsection 4. is hereby added to Section 8003.1.14 to read as follows: 4. The area of the overhead shelter shall not exceed 3,000 square feet. ARTICLE 4. HAZARDOUS MATERIALS, COMMUNITY RIGHT TO KNOW Section 3-3-405: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW - ENFORCEMENT. The City of San Leandro Fire Department is hereby designated as the agency of the City responsible for the administration and enforcement of Chapter 6.95, Division 20 of the California Health and Safety Cade. Section 3-3-410: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW - FEES. Pursuant to Chapter 695, Division 20 of the California Health and Safety Code, and specifically California Health and Safety Code Section 25513, a schedule of fees shall be imposed by resolution of the City Council. Section 3-3-415: HAZARDOUS MATERIALS, COMMUNITY RIGHT-TO-KNOW - VIOLATIONS AND PENALTIES. The violations and penalties as set forth in Chapter 6.95, Division 20 of the California Health and Safety Code are hereby specifically adopted." Section 3. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the Ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause phrase of the Ordinance irrespective of the fact that one or more of them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance are declared to be severable. Section 4. Effective Date and Publication. This ordinance shall take effect on November 1, 2002 and the title thereof shall be published once prior to adoption. io
