(3) The Building Official may authorize the refunding of not more than eighty <br />percent (80%) of the plan review fee paid when an application for a permit <br />for which a plan review fee has been paid is withdrawn or canceled before <br />any plan reviewing is done. <br />(4) The Building official shall not authorize the refunding of any fee paid <br />except upon written application filed by the original permittee not later <br />than one hundred eighty (180) days after the date of fee payment. <br />Section 7-5-120: RESERVED. <br />Section 7-5-125: PERMITS. Section 106.2, Number 2 is hereby amended to read as <br />follows: <br />Fences not over 6 feet high and fences of wood or other material, weighing less than 10 pounds <br />per square foot, not over 7 feet high, when located in the rear yard setback area as defined in the <br />zoning code. <br />Section 7-5-130: PEDESTRIAN WALKWAYS OVER PUBLIC PROPERTY. Pedestrian <br />walkways over public property shall be subject to the approval of the City. Notwithstanding the <br />preceding sentence, sidewalk arcades on public property in an established redevelopment project <br />area need not be considered as adjacent buildings for the provisions of this Chapter, provided that <br />the arcades are of not less than one (1) hour fire resistive construction or are constructed entirely <br />of noncombustible materials, fire retardant treated wood or heavy timber construction with two- <br />inch (2") nominal sheathing, or a combination of the above materials. <br />Section 7-5-135: ROOF COVERINGS. Section 1503 is hereby amended to read as follows: <br />Every new structure, and every existing structure when 50 percent or more of the total roof area <br />is reroofed within any one-year period, commencing any date on or after January 1, 1996 shall <br />have a minimum Class C fire retardant roof covering. <br />Section '7-5-140: RESERVED. <br />Section 7-5-145: MULTIPLE HAZARDS: OUTDOOR STORAGE. <br />(a) When a hazardous material has multiple hazards, all hazards shall be addressed <br />and controlled in accordance with the provisions of this chapter. When overhead <br />noncombustible construction is provided for sheltering exterior hazardous <br />material storage areas, such storage shall not be considered indoor storage when <br />all of the following conditions are met: <br />(1) Supports shall be of noncombustible construction. <br />(2) Supports and walls shall not obstruct more than 25 percent of the <br />perimeter of the storage area. <br />4 <br />
