given proper notice of a Board hearing as required by Section 4-32-305 above fails to <br />appear before the Board without good cause, or if both the tenant and landlord fail to <br />appear without good cause, the Board shall dismiss the case and the tenant will be barred <br />from subsequently challenging such increase before the Board. <br />SECTION 6. Section 1-3-1400 of the City of San Leandro Municipal Code is hereby <br />amended to read as follows: <br />1-3-1400 MEMBERSHIP. <br />The Rent Review Board shall consist of five (5) members. Two (2) members of the <br />Board shall be tenants, two (2) members shall be landlords that own rental property in <br />San Leandro, and one (1) member shall be neither a tenant nor a landlord. One (1) of the <br />landlord members may reside outside the City of San Leandro. <br />SECTION 7. Severability. <br />If any section, subsection, subdivision, paragraph, sentence, clause or <br />phrase of the Ordinance is for any reason held to be unconstitutional, invalid, or <br />ineffective by any court of competent jurisdiction, such decision shall not affect the <br />validity or effectiveness of the remaining portions of this Ordinance or any part hereof. <br />The City Council hereby declares that it would have passed each section, subsection, <br />subdivision, paragraph, sentence, clause and phrase of the Ordinance irrespective of the <br />fact that one or more of them would be declared unconstitutional or invalid. To this end, <br />the provisions of the Ordinance are declared to be severable. <br />SECTION $.
