IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2002 - 030 (1035/1076) <br />AN ORDINANCE AMENDING CHAPTER 3 <br />OF TITLE III OF THE SAN LEANDRO MUNICIPAL CODE <br />RECITALS <br />A. The City Council previously adopted a resolution and ordinance updating Chapter 3, Title III <br />of the San Leandro Municipal Code, "Uniform Fire Code," ("Code") adopting by reference the <br />Uniform Fire Code, 2000 Edition, as amended by the State of California in that document entitled <br />"The California Building Standards Code," 2001 edition, and said ordinance went into effect on <br />November 1, 2002. <br />B. The City Council has determined that certain additional changes to Chapter 3, Title III of the <br />San Leandro Municipal Code are necessary to clarify the specific Uniform Fire Code appendixes <br />incorporated into the City's Code and to amend Section 5202.3.7.3 of the Uniform Fire Code, 2000 <br />Edition, as amended by the State of California in that document entitled "The California Building <br />Standards Code," 2001 edition. <br />C. In order to comply with California Health and Safety Code Section 17958, permitting cities to <br />amend the requirements of the California Building Standards Code in accordance with Health and <br />Safety Code Sections 17958.5 and 17958.7, the City must make express findings that the change to <br />Section 5202.3.7.3 is reasonably necessary because of local climatic, geological, or topographical <br />conditions. <br />D. Under Health and Safety Code Section 17958.7, changes pursuant to Health and Safety Code <br />Section 17958.5 may not become effective until the required findings, and the changes, have been <br />filed with the California Building Standards Commission. <br />E. The City Council has reviewed the reasons for the proposed change to Section 5202.3.7.3. <br />F. The City Council finds that the change to Section 5202.3.7.3 is reasonably necessary in order <br />to lessen the threat to life, safety and property represented by certain local climatic, geographical and <br />topographical conditions existing in the City of San Leandro <br />G. The City Council finds that the change to Section 5202.3.7.3 is enacted pursuant to the <br />authority of Section 17958.5 of the California Health and Safety Code, for the purpose of addressing <br />the aforesaid conditions which are more specifically described as follows: <br />(a) The City of San Leandro lies in the near vicinity of the Hayward Fault and in <br />fact, a substantial portion of the residential area of the City lies within the <br />Alquist-Priolo Act Special Studies Zone, requiring special geologic studies <br />prior to development. <br />
