welfare, and is declared and deemed a nuisance. Such violation may be abated in the <br />manner provided in Chapter 1-12. Any violation of a discharge standard and/or <br />requirement of these regulations, applicable State or Federal regulations or any order <br />issued by the City as authorized by these regulations, is hereby declared a public nuisance <br />and shall be corrected or abated as directed by the City. Any person creating a public <br />nuisance shall be subject the provisions of this Code or other laws or ordinances <br />governing such nuisance. Such nuisance may be abated, removed or enjoined and <br />damages assessed therefore, in any manner provided by law or this Code. <br />The cost of such abatement and restoration shall be borne by the owner of the <br />property, and the cost thereof shall be a lien upon and against the property. The lien <br />procedures in Chapter 1-12 of this Code shall be followed for any such lien. <br />If violation of this Chapter constitutes a seasonal and recurrent nuisance, the City <br />shall so declare. Thereafter, such seasonal and recurrent nuisance shall be abated every <br />year without the necessity of any further hearing. <br />SECTION 9. Section 4-1-100 of the City of San Leandro Municipal Code is hereby <br />amended to read as follows: <br />4-1-100 Violation as Public Nuisance. <br />Any violations of the provisions of this Chapter are expressly deemed and <br />declared to be a public nuisance, and such violation shall be abated in the manner <br />provided in Chapter 1-12. <br />SECTION 10. Section 4-1-410 of the City of San Leandro Municipal Code is <br />hereby amended to read as follows: <br />4-1-410 Enforcement. <br />Any violation of the provisions of this Article may be abated in the manner <br />provided in Chapter 1-12. In addition, enforcement may be had by issuing the notice <br />provided in Section 4-1-400. Such notice shall be in writing and may be given by <br />personal service on the violator, or by registered or certified mail addressed to the <br />violator, or by posting such notice in a conspicuous place or places on the premises where <br />the violation has occurred. <br />SECTION 11. Section 4-2-230 of the City of San Leandro Municipal Code is <br />hereby amended to read as follows: <br />4-2-230 Violation as Public Nuisance. <br />Any violations of the provisions of this Chapter are expressly deemed and <br />declared to be a public nuisance, and such violations shall be abated in the manner <br />provided in Chapter 1-12. <br />188745-1 <br />
