IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2008- (1055) <br />RESOLUTION CALLING A SPECIAL MUNICIPAL RUNOFF ELECTION FOR THE <br />ELECTION OF CITY COUNCILMEMBER, DISTRICT 2; PROVIDING NOTICE OF <br />ELECTION ON THE 4TH DAY OF NOVEMBER, 2008 AND DIRECTING THAT SAID <br />NOTICE BE GIVEN; AND REQUESTING THAT THE ALAMEDA COUNTY BOARD OF <br />SUPERVISORS PERMIT THE CONSOLIDATION OF SAID MUNICIPAL ELECTION WITH <br />THE STATEWIDE GENERAL ELECTION TO BEHELD ON NOVEMBER 4, 2008 AND <br />DIRECT THE ALAMEDA COUNTY REGISTRAR OF VOTERS TO PROVIDE ALL <br />NECESSARY SERVICES RELATED TO SAID ELECTION <br />WHEREAS, a General Municipal Election was held on Tuesday, June 3, 2008, for the <br />purpose of electing City Councilmembers for Districts 2, 4 and 6 for a full term of four years; <br />and <br />WHEREAS, no candidate for the office of City Councilmember, District 2 received at <br />least 50% plus one of the votes cast for that office; and <br />WHEREAS, Section 225(b) of the Charter of the City of San Leandro requires a <br />successful candidate for elective office to receive at least 50% plus one of the votes cast for that <br />office, and in the event that no candidate for such elective office receives 50% plus one of the <br />votes cast for that office, the City Council shall provide for a runoff vote to determine the person <br />elected; and <br />WHEREAS, Ordinance No. 2006-008 of the City Council of the City of San Leandro sets <br />forth the procedure for the conduct of runoff elections among the two persons having the highest <br />number of votes for an office by requesting the Alameda County Board of Supervisors to permit <br />the consolidation of the City's Municipal Runoff Election with the Statewide General Election in <br />November following the City's General Municipal Election. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />DOES RESOLVE AS FOLLOWS: <br />SECTION 1. Pursuant to the provisions of Sections 225(b) and 605 of the Charter of the <br />City of San Leandro, the City Council hereby calls a Special Municipal Runoff Election, to be <br />held on November 4, 2008, among the two persons having the highest number of votes for the <br />office of City Councilmember, District 2, in the June 3, 2008 General Municipal Election. <br />SECTION 2. Notice of the time and place of holding said election is hereby given and <br />the City Clerk as the Elections Official of the City of San Leandro is hereby directed to publish, <br />post and give such further additional notice of said election as prescribed by the Elections Code <br />of the State of California, and to take such other actions as may be deemed necessary and <br />appropriate to carry out the purpose and intent of this Resolution, the City Charter, Municipal <br />
