CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: July 21, 2008 <br />TO: City Council <br />FROM: John Jermanis, City Manager <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Jo ermanis <br />Ci nager <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />RESOLUTION AUTHORIZING AN AMENDMENT TO THE LEGAL SERVICES <br />AGREEMENT WITH THE LAW FIRM OF MEYERS, NAVE, RIBACK, SILVER & <br />WILSON (MEYERS NAVE) TO PROVIDE CITY ATTORNEY SERVICES TO THE <br />CITY OF SAN LEANDRO <br />SUMMARY AND RECOMMENDATION <br />It is recommended that the City Council approve a resolution authorizing Amendment <br />No. 3 to the Legal Services Agreement with Meyers Nave to provide legal services to the <br />City of San Leandro as City Attorney. <br />The proposed amendment clarifies the scope of legal services performed by the City <br />Attorney and authorizes an increase in rate. <br />BACKGROUND <br />On March 13, 1986, the City entered into an Agreement with the law firm of Meyers, <br />Nave, Riback, Silver & Wilson, to provide legal services to the City of San Leandro as <br />City Attorney. The Agreement with Meyers Nave at that time provided for the <br />continuation of City Attorney services provided by Steve Meyers who had served as the <br />City Attorney since 1979. <br />Since that time, the City has authorized two (2) amendments to the Agreement, the most <br />recent being in July 2005. This proposed amendment will serve to further clarify the <br />scope of services performed by Meyers Nave and provides for an increase in rates. <br />DISCUSSION: <br />The current Agreement provides for four (4) categories of legal services: Basic Services <br />(retainer); Special Services (hourly rate); Cost Recovery (hourly rate); and Other Services <br />(hourly rate). Basic Services generally consist of those services normally provided by the <br />City Attorney as the City's general counsel. These services are compensated at a fixed <br />
