Code Enforcement matters subject to lien enforcement Term of Agreement This Agreement shall commence on July 1, 2008 and shall continue indefinitely thereafter until otherwise terminated. 4. Staffing Assignments Jayne W. Williams is designated to serve as City Attorney and she shall be primarily responsible for the provision of legal services to the City. Subject to the City's consent and approval, Meyers Nave shall assign an attorney as Assistant City Attorney who shall perform the City Attorney's services when the City Attorney is unable to attend to the "basic level of services" due to illness, disability, vacation or a scheduling conflict. Associate attorneys and legal assistants shall be utilized when necessary to assist in providing legal services as is appropriate for their level of experience. 5. Compensation for Legal Services A. For "Basic Level of Services" For City Attorney services outlined in paragraph 1 above, Meyers Nave shall bill the City at a monthly retainer of $ 27,730.00 (Twenty seven thousand seven hundred and thirty dollars) per month. B. Additional Legal Services Legal services outside of the basic level of services, as outlined in relevant sections of paragraph No. 2 above, will be billed at $210.00 per hour for attorneys and $105.00 for paralegals. Legal services, for which the City can be reimbursed by third parties, as outlined in relevant sections of paragraph 2 above, shall be billed at a cost recovery rate of $250.00 per hour and $110.00 for paralegals, C. Travel Meyers Nave may charge City for mileage and/or travel expenses at the IRS permitted rate; however Meyers Nave may not charge City both for travel time and mileageltravel expenses. -4-
