CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: July 28, 2008 <br />TO: John Jermanis, City Manager <br />FROM: Steve Hollister~~ tant City Manager <br />BY: Marian Handa, City Clerk ,~,~ <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />John ermanis <br />City fnager <br />RESOLUTION APPROVING AMENDMENT TO ALAMEDA COUNTY WASTE <br />MANAGEMENT AUTHORITY JOINT EXERCISE OF POWERS AGREEMENT <br />SUMMARY AND RECOMMENDATION <br />The proposed amendment to the Joint Exercise of Powers Agreement (JPA) for the Alameda <br />County Waste Management Authority (ACWMA) would simplify voting procedures for the <br />ACWMA Board by changing the requirement for atwo-thirds vote to a majority vote for most <br />actions. It is recommended that the City Council adopt the resolution approving this amendment. <br />BACKGROUND <br />The City of San Leandro is a member of the ACWMA, which was created pursuant to the JPA <br />for Waste Management dated February 13, 1990. There are 17 member agencies in the <br />Authority, each with a representative on the Authority Board. <br />Currently, the JPA requires atwo-thirds vote for approval of all ordinances and resolutions, and <br />a majority vote for all other actions. At its meeting on June 25, 2008, the ACWMA Board <br />recommended an amendment to the JPA to maintain the two-thirds vote requirement for actions <br />requiring the expenditure of $500,000 or more, but to approve all other actions by majority vote. <br />This change would streamline the voting process for most actions, while ensuring that decisions <br />having significant fiscal impact continue to require a broad consensus of the Board. <br />In accordance with the JPA, the amendment must be submitted to all of the ACWMA's member <br />agencies for approval.
