Mr. Jermanis indicated that, absent the declaration of a fiscal emergency, the next opportunity would be in 2010. Ms. Williams suggested a minor revision to the ballot language proposed by Mr. Gilcrest for the 911 Tax measure. A motion was made by Councilmember Prola, seconded by Vice Mayor Stephens, to adopt the resolution placing the 911 Tax Ordinance, with the ballot language proposed by Mr. Gilcrest and modified by City Attorney Williams, on the November 4, 2008 ballot. Resolution No. 2008-098 , Resolution Establishing November 4, 2008, as the Date for a Municipal Election on a Proposed Ballot Measure Seeking Voter Authorization for the Re Ordinance, Establishing Policies and Procedures in Connection with Such an Election, and Requesting that the Alameda County Chief Elections Officer Conduct Such an Election (proposes a m Access Fee Ordinance, update certain elements of the ordinance and address legal concerns, and authorizes the Revenue Ad Hoc Committee of the City Council to prepare an argument and a rebuttal argument in favor of the measure). The Council discussed options for the Police Services Parcel Tax, including a sunset clause, an exemption for senior citizens, and a flat rate per parcel. Mr. Jermanis pointed out that assessing a flate rate would shift a disproportionate share of the tax burden on residential parcels, and industrial/commercial properties would not be paying their fair share.
