IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2008- <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE REAL PROPERTY <br />AGREEMENTS FOR PROPERTY(S~ REQUIRED FOR THE EAST 14TH <br />STREET/HESPERIAN BOULEVARD/150 H AVENUE IMPROVEMENT PROJECT, <br />PROJECT NO. 144-39-001 <br />Pursuant to Municipal Code Section 1-6-106, the City Manager is hereby authorized to <br />execute real property purchase agreement(s) for the property(s) necessary for the East 14th <br />Street/Hesperian Boulevard/150` Avenue Improvement project when terms and conditions of <br />such acquisition(s) are within the fair market appraisal(s) obtained by the City or the <br />compensation paid is otherwise fair, just, and equitable. <br />Said property acquisition(s) are considered categorically exempt from the California <br />Environmental Quality Act (CEQA) Article 19 Section 15301, Class 1. <br />Said property acquisition(s) are determined by the Planning Commission to be in <br />conformance with the City's General Plan under Government Code Section 65402. <br />NOW THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager is authorized to execute agreement(s) for the acquisition(s) of <br />property(s) at the location(s) required for the East 14`h Street/Hesperian Boulevard/150th Avenue <br />Improvement Project on behalf of the City of San Leandro. <br />Introduced by Councilmember and passed and adopted <br />this 2"d day of September, 2008 by the following called vote: <br />Members of the Council: <br />AYES: <br />NOES: <br />ABSENT: <br />ATTEST: <br />Marian Handa, City Clerk <br />K:\AA-C\COUNCIL\2008\9 SEP 2\TRIANGLE AGREEMENT CM AUTH RES.docx <br />
