MINUTES Page 8 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-July 28, 2008 <br />Resolution No. 2008-097, Resolution Establishing November 4, 2008, as the Date for <br />an Election on a Proposed Ballot Measure Seeking Voter Approval to Modify the City's <br />Existing Utility Users' Tax for General Fund Purposes, Establishing the Policies and <br />Procedures for Such an Election and Requesting that the County of Alameda Conduct <br />Such an Election (proposes a measure to modernize the Utility Users' Tax [UUT] <br />Ordinance by lowering the rate for telecommunication and video services from 6% to <br />5.7%, and authorizes the Revenue Ad Hoc Committee of the City Council to prepare an <br />argument and a rebuttal argument in favor of the measure). Mr. Jermanis indicated that, absent the declaration of a fiscal emergency, <br />the next opportunity would be in 2010. Ms. Williams suggested a minor revision to the <br />ballot language proposed by Mr. Gilcrest for the 911 Tax measure. <br />A motion was made by Councilmember Prola, seconded by Vice Mayor Stephens, to <br />adopt the resolution placing the 911 Tax Ordinance, with the ballot language proposed <br />by Mr. Gilcrest and modified by City Attorney Williams, on the November 4, 2008 <br />ballot. <br />Resolution No. 2008-098, Resolution Establishing November 4, 2008, as the Date for a <br />Municipal Election on a Proposed Ballot Measure Seeking Voter Authorization for the <br />City's Emergency Communication System Access Tax for Enhanced 911 Services; and <br />Repealing the City's Existing Emergency Communication System Access Fee <br />Ordinance, Establishing Policies and Procedures in Connection with Such an Election, <br />and Requesting that the Alameda County Chief Elections Officer Conduct Such an <br />Election (proposes a measure to rescind the City's current Emergency Communication <br />Access Fee Ordinance, update certain elements of the ordinance and address legal <br />concerns, and authorizes the Revenue Ad Hoc Committee of the City Council to prepare <br />an argument and a rebuttal argument in favor of the measure). Ayes: 5; Noes: 2 (Santos and Souza) <br />A motion was made by Councilmember Souza, seconded by Councilmember Grant, to <br />adopt the resolution placing the Police Services Parcel Tax on the November 4, 2008 <br />ballot. <br />The Council discussed options for the Police Services Parcel Tax, including a sunset <br />clause, an exemption for senior citizens, and a flat rate per parcel Mr. Jermanis pointed <br />out that assessing a Hate rate would shift a disproportionate share of the tax burden on <br />residential parcels, and industriaUcommercial properties would not be paying their fair <br />share. In response to a question by Councilmember Gregory regarding the percentage of <br />police calls received for various types of parcels, Police Chief Attarian indicated that <br />
