2. The design of the gabled roofs for the proposed front porch and second story <br />squared bay shall be modified so that the projecting eves are less <br />pronounced. <br />3. Attic vents shall be modified from the `half-circle' shape to square or <br />rectangular on both the house and the detached garage structure. <br />G. The subject residence shall be limited to single-family occupancy, only, unless the <br />City grants approval of a permit for any other unit. For the purposes of this <br />condition, installation of any appliances for cooking, including, but not limited to <br />a stove, hot plate or microwave oven, in any room other than the individual <br />kitchen in the existing dwelling unit within the single-family home, shall be <br />deemed the creation of an additional kitchen and therefore creation of an <br />additional dwelling unit. Specifically, bedrooms or any room other than the <br />designated kitchen in the home on the property shall not have any other kitchen <br />and shall not be acknowledged as a separate dwelling unit at the subject property. <br />H. Pursuant to Zoning Code Section 2-520 (Maximum Dwelling Unit Occupancy), a <br />zoning permit shall be required for occupancy of a dwelling unit by more than ten <br />(10) persons eighteen (18) years or older. <br />L Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design or materials shall <br />be subject to the review and approval of the Zoning Enforcement Official. <br />IL GENERAL CONDITIONS <br />B. Any new exterior lighting shall be shielded or directed away from neighboring <br />residential properties. <br />C. All structures shall be structurally sound and well maintained at all times; any <br />damage to the structures shall be promptly repaired. <br />D. Any graffiti on the property shall be promptly removed. <br />E. Landscaping within public view in front and side yards shall be maintained in <br />healthy, growing conditions. <br />F. Construction activity shall not commence prior to 7:00 a.m. and shall cease by <br />7:00 p.m. Monday through Friday, and construction activity shall not commence <br />prior to 8:00 a.rn. and shall cease by 7:00 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As provided in this City of San <br />Leandro's Noise Ordinance (ORDINANCE NO. 2003 - 005), "construction" shall <br />mean any site preparation, assembly, erection, substantial repair, alteration, <br />demolition or similar action, for or on any private property, public or private right- <br />of-way, streets, structures, utilities, facilities, or other similar property. <br />Construction activities carried on in violation of this Article may be enforced as <br />Agreement to Conditions March 4, 2008 <br />PLN2007-00074 Page 4 of 5 <br />
