B. Hours of construction shall be limited to the hours of 7 a.m. and 7 p.m. on <br />weekdays, or between 8 a.m. and 7 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As used in this Article, <br />"construction" shall mean any site preparation, assembly, erection, substantial <br />repair, alteration, demolition or similar action, for or on any private property, <br />public or private right-of--way, streets, structures, utilities, facilities, or other <br />similar property. Construction activities carried on in violation of this Article may <br />be enforced as provided in Section 4-1-1130, and may also be enforced by <br />issuance of a stop work order and/or revocation of any or all permits issued for <br />such construction activity. <br />VII. GE1~IERAI, CONDITIONS <br />A. There shall be no outdoor storage of any type on the property, specifically in the <br />driveway areas. The garages and driveways shall be kept free of obstruction and <br />available for their designated use for vehicle parking at all times. The driveway area <br />adjacent to the existing dwelling and the existing two-car garage shall be posted and <br />kept unobstructed to maintain emergency vehicle access to the rear portion of the <br />property, to the satisfaction of the Fire Department. <br />B. All garbage and recycle bins for each residence shall be kept between the two <br />residences out of view from the public right-of--way on non-service days. <br />C. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br />D. No application for amendment of the application or Conditions of Approval may be <br />accepted or submitted for processing by the City unless (i) there is full compliance <br />with all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director waives compliance with the terms of the application and <br />Conditions of Approval pending application for the amendment. <br />E. The applicant and/ar property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility far this zoning approval is <br />informed of its terms and conditions. <br />F. Construction shall commence within one (1) year following Zoning Enforcement <br />Official approval of the Site Plan Review and Administrative Exception (April 15, <br />2009) and shall be substantially completed one year after commencement of <br />construction. For the purpose of compliance with this condition, commencement of <br />construction shall be defined as the pouring of the foundation for the addition to the <br />existing detached two-car garage to create the new secondary dwelling. <br />Agreement to Conditions April 15, 2008 <br />PLN2008-00011 Page b of 6 <br />
