IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2008-114 (3145) <br />RESOLUTION AUTHORIZING THE EXECUTION OF A DESIGN/BUILD <br />CONTRACTUAL SERVICES AGREEMENT WITH SIEMENS BUILDING <br />TECHNOLOGIES, INC. IN THE AMOUNT OF $3,287,124 FOR THE DESIGN <br />AND CONSTRUCTION OF A WATER POLLUTION CONTROL PLANT CO- <br />GENERATION PROJECT NO. 08-593-52-228, CONDUCTING A PUBLIC <br />HEARING IN CONNECTION WITH THE WATER POLLUTION CONTROL <br />PLANT, ADOPTING FINDINGS IN SUPPORT THEREOF, AND <br />APPROPRIATION OF WATER POLLUTION CONTROL PLANT FUNDS IN <br />THE AMOUNT OF $3,287,124 <br />WHEREAS, the City operates and maintains the Water Pollution Control Plant <br />("WPCP"), which treats an average of six million gallons per day of municipal and industrial <br />wastewater; and <br />WHEREAS, to heat hot water used by the boilers in the WPCP during the treatment <br />process, the City currently purchases electricity from Pacific Gas & Electricity ("PG&E") at <br />commercial retail rates; and <br />WHEREAS, the City's purchase of electricity for use at the WPCP contributes to the <br />emission of greenhouse gases within the State of California; and <br />WHEREAS, the City desires to acquire and install a co-generation facility at the existing <br />WPCP in order to reduce the amount of electricity it purchases from PG&E; and <br />WHEREAS, as designed, a co-generation facility will convert methane gas produced at <br />the WPCP into electricity for use at the WPCP thereby reducing the emission of greenhouse <br />gases; and <br />WHEREAS, in 2007, the City issued a Request for Proposals in order to solicit proposals <br />from qualified firms for the design/build of a co-generation plant at the WPCP; and <br />WHEREAS, after a series of interviews, City staff selected Siemens Building <br />Technologies, Inc. ("Siemens") to enter into negotiations for the design/build of a co-generation <br />facility at the WPCP; and <br />WHEREAS, the City staff and Siemens have successfully negotiated a "DesignBuild <br />Contractual Services Agreement" ("Agreement") which requires Siemens to design build and <br />maintain a co-generation facility at the WPCP ("Project") at a cost to the City of $3,287,124; and <br />WHEREAS, on the 1St day of September, 2008, the City Clerk of the City published a <br />notice of public hearing in the Daily Review regarding this City Council's consideration of the <br />Project and costs of the Project to the City; and <br />
