Planning Commission Meeting Minutes August 28, 2008 <br />Agenda No. 08-16 Page 7 of 11 <br />Ned B. Kisner, who owns property at 1930 Fairview Drive, which is near the proposed <br />development site, noted that the property is zoned industrial, with conditional uses, <br />including one that applies to the business he has operated there for 24 years. During the <br />scoping, he urges ensuring that none of the legitimate industrial uses in the area are <br />affected in any way. For instance, he believes one requirement of his conditional use, <br />which specifies a certain distance from any residences, may be violated by development <br />of the residential part of the proposal. He noted, too, that the Kaiser Permanente portion <br />of the development, particularly the hospital, comes very close to his property, although <br />he is uncertain about any requirement that his business be a certain distance from a <br />hospital. These issues, he said, need to be addressed. In addition, he noted that the area <br />lies within a Redevelopment Agency jurisdiction. While he does not know what impacts <br />the proposed development may have in that respect, he said that scoping should include <br />evaluation of that issue. From a personal point of view, he urged that the zone remain <br />industrial, in that San Leandro has been an industrial community for many years. While <br />much of the industrial base has gone away and it has shifted in its impact, he was part of <br />the group when Redevelopment Agency planning was underway. At that time, he and <br />other property owners made considerable concessions and he wants to ensure that all the <br />agreements reached in that process remain applicable now and in the future. <br />Commissioner Abero asked what kind of business Mr. Kisner has at 1930 Fairview <br />Drive. <br />Mr. Kisner replied that he operates a paint manufacturing facility (Triangle Coatings). <br />Wafaa Aborashed, 3081 Teagarden Street, indicated that she thought afive-minute <br />presentation was the norm for speakers in a Public Hearing rather than three minutes. <br />Acting Chair Dlugosh said that the five-minute standard applies to Agenda Item 2, <br />Public Comments, at which time the public may make comments unrelated to topics <br />under Agenda Item 6, Public Hearings. To be fair to the others speaking to the Public <br />Hearing issues, he said the three-minute standard would apply to all. <br />Ms. Aborashed is the Executive Director for Healthy San Leandro Environmental <br />Collaborative. She said that she wants more information to clarify what scoping is, and <br />noted that she is concerned about having a hospital next to I-880. She called attention to <br />numerous accidents in that area in the past year alone. About a month ago, for instance, a <br />couple of trucks were involved in a fatal accident. The diesel particulate matter that <br />comes out of such accidents will impact the hospital unless the windows remain closed, <br />she said. Her group also has concerns about building new housing next to a freeway. <br />Healthy San Leandro and ARB have produced studies that discourage building next to <br />freeways due to heightened cancer and asthma rates resulting from vehicle emissions. <br />She described the asthma rates in the area as "unbelievable." There are five schools in the <br />area, which is another matter of concern on the health front. Even now, she said, trucks <br />and the idling they do affects the children in the schools and area residents, and there <br />seems to be nothing can be done about it. She said she is glad the area will be rezoned. <br />Her group has been studying West San Leandro, the industries in the area and their <br />emissions of particulate matter that affect nearby school populations. Ms. Aborashed also <br />noted that she has seen nothing about how increased traffic resulting from the proposed <br />development would be handled. <br />
