STAFF ANALYSIS <br />The Parcel Map and the Condominium Plan conforms to the conditional use permits (PLN2005- <br />00027 and PLN2008-00027). Covenants, conditions and restrictions (CC&Rs) have already been <br />drafted and referenced on the map. The CC&Rs provide for the maintenance of the lot, such as <br />driveways, fencing, and landscaping. <br />Inclusionary Requirement <br />Zoning Code Article 30, Affordable Housing-Inclusionary Zoning Requirement is applicable to the <br />application. It requires 15% inclusionary units or payment of an in-lieu fee to the Affordable <br />Housing Trust Fund for conversion of rental projects to projects that are for-sale or for ownership. <br />Pursuant to the Article any residential project including a minimum of two new units for-sale is <br />subject to the inclusionary requirement. <br />For residential developments of for-sale projects of six or fewer units, the Inclusionary Housing <br />Ordinance requirements may be satisfied by paying an in-lieu fee, instead of providing an actual <br />unit. The fee is the median sales price of athree-bedroom townhouse dwelling unit in San <br />Leandro, minus the Affordable Ownership Cost (calculated monthly by the Bay East Association <br />of Realtors), multiplied by the fractional inclusionary units required. The fractional inclusionary <br />unit required (15°/0) for the two units would be 0.30. The fee is based on the price and cost figures <br />established by the City at the time of the Final Map. <br />Prior to recordation of the final map for the condominium conversion, the applicant shall provide <br />the City of San Leandro with an in-lieu payment to satisfy the Inclusionary Requirement as <br />determined by the City of San Leandro Housing Division of the Community Development <br />Department per Zoning Code Section 6-3012. <br />SUMMARY AND RECOMMENDATION <br />1. Parcel Map 9804 is in conformance with the approved conditional use permit to convert <br />the units into a condominium for sale and ownership as two individual units on the single <br />lot (PLN2008-00027). <br />2. Parcel Map 9804 is in compliance with Title VII, Chapter 1 of the San Leandro <br />Municipal Code (Subdivision Ordinance). <br />3. Parcel Map 9804 is in compliance with the Subdivision Map Act (California Government <br />Code). <br />4. Parcel Map 9804 is consistent with the objectives, policies, land use and programs in the <br />City of San Leandro's General Plan. <br />Subject to the comments above, I recommend that Parcel Map 9804 be approved. However prior to <br />the recordation of the Parcel Map 9804 with Alameda County the property owner shall make <br />payment to the City of San Leandro the in-lieu payment to satisfy the Inclusionary Requirement as <br />determined by the City of San Leandro Housing Division per Zoning Code Section b-3012. <br />City Planner's Report September 22, 2008 <br />Parcel Map 9804 Page 2 of 2 <br />
