IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2008-134 (2318) <br />RESOLUTION AMENDING TITLE 12, CHAPTER 8 <br />OF THE SAN LEANDRO ADMINISTRATIVE CODE <br />RELATING TO STREET TREE POLICY AND PROCEDURE <br />WHEREAS, Title 5, Chapter 5-2 of the San Leandro Municipal Code designates the Public <br />Works Director to handle matters relating to street trees; and <br />WHEREAS, Title 12, Chapter 8 of the San Leandro Administrative Code designates the <br />City Manager to handle certain matters relating to street tree removal and the City Manager <br />delegates such matters to the Public Works Director. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE that <br />§ 12.8.110 and § 12.8.126 of the San Leandro Administrative Code are hereby amended to read as <br />follows: <br />X12.8.110 STREET TREE REMOVAL. The City will remove a street tree under the <br />following circumstances: <br />(a) Where the tree is dead or damaged beyond expected recuperation (by storm, vehicle <br />accident, etc.). <br />(b) Where hazardous conditions exist (e.g., a tree in danger of falling over). <br />(~} ,(~ Where the City determines a tree has caused concrete or sewer damage and further <br />damage cannot be prevented by normal tree maintenance measures, such as root pruning. <br />~) ~ Where the City is engaged in a scheduled and phased tree removal and replacement <br />program. <br />(~} ~ Under unusual hardship circumstances upon approval by the ~'~'-~ "~~~~^°~ ^~ a°~;^„°+°~ <br />Public Works Services Director. <br />12.8.126 ADMINISTRATIVE AUTHORITY. In order to provide for a sustainable urban <br />forest within San Leandro neighborhoods, street trees within identified neighborhoods, which <br />may have grown beyond the public right-of--way, may require maintenance by the City. The <br />Imager Public Works Services Director is hereby given administrative authority to adopt <br />policies pertinent to the maintenance of street trees as deemed necessary. <br />Introduced by Councilmember Stephens and passed and adopted this aid day of November, <br />2008, by the following called vote: <br />
