IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2008-134 (2318) RESOLUTION AMENDING TITLE 12, CHAPTER 8 OF THE SAN LEANDRO ADMINISTRATIVE CODE RELATING TO STREET TREE POLICY AND PROCEDURE WHEREAS, Title 5, Chapter 5-2 of the San Leandro Municipal Code designates the Public Works Director to handle matters relating to street trees; and WHEREAS, Title 12, Chapter 8 of the San Leandro Administrative Code designates the City Manager to handle certain matters relating to street tree removal and the City Manager delegates such matters to the Public Works Director. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE that § 12.8.110 and § 12.8.126 of the San Leandro Administrative Code are hereby amended to read as follows: X12.8.110 STREET TREE REMOVAL. The City will remove a street tree under the following circumstances: (a) Where the tree is dead or damaged beyond expected recuperation (by storm, vehicle accident, etc.). (b) Where hazardous conditions exist (e.g., a tree in danger of falling over). (~} ,(~ Where the City determines a tree has caused concrete or sewer damage and further damage cannot be prevented by normal tree maintenance measures, such as root pruning. ~) ~ Where the City is engaged in a scheduled and phased tree removal and replacement program. (~} ~ Under unusual hardship circumstances upon approval by the ~'~'-~ "~~~~^°~ ^~ a°~;^„°+°~ Public Works Services Director. 12.8.126 ADMINISTRATIVE AUTHORITY. In order to provide for a sustainable urban forest within San Leandro neighborhoods, street trees within identified neighborhoods, which may have grown beyond the public right-of--way, may require maintenance by the City. The Imager Public Works Services Director is hereby given administrative authority to adopt policies pertinent to the maintenance of street trees as deemed necessary.
