the downtown and BART in a way that would not likely impact persons or properties in the
immediate area.
Parkin
The seven off-street parking spaces in the westerly portion of the property would more than
satisfy the parking for the proposed uses (Zoning Code Section 4-1704). The single-family home
is required one and one-half off-street parking spaces; the office use is required zero spaces (for
offices or retail with less than 5,000 square feet in the DA Districts); and the two studio
apartments would be required three spaces (one and one-half space per studio unit.). The seven
spaces exceed the 4.5 or five space requirement (when rounded up).
ENVIRONMENTAL ANALYSIS
This project to reuse existing facilities is categorically exempt from the California Environmental
Quality Act (CEQA) per CEQA Guideline Article 19, Categorical Exemption, Section 15301.
PUBLIC OUTREACH
The following public outreach was performed: a legal advertisement for the public hearing was
placed in the Daily Review newspaper; public hearing notification letters were mailed to the
property owners within 300 feet of the subject property and the Peralta Citizens Homeowners
Association; and public notification placards were posted on the utility poles adjacent to the
subject property.
RECOMMENDATION
Staff recommends that the Planning Commission review the proposed PD Modification, accept
public comments, and after closing its public hearing, have Commission discussion and provide
its recommendation to the City Council.
If the Commission finds that the proposal appears to be an orderly use of the property that
conforms to intent of the DA -3 Downtown Area base district and finds the increase reasonable
which respects the scale and fabric of the neighborhood, staff recommends that the Planning
Commission forward a recommendation for approval to the City Council.
Both recommendations from the Library—Historical Commission and the Planning Commission
would be provided to the City Council at its public hearing for a decision to this matter.
ATTACHMENTS
Vicinity Map
Recommended Findings of Fact
Recommended Conditions of Approval
Excerpts from the Minutes of the Library -Historical Commission Meeting on October 16, 2007
Excerpts from the Minutes of the Library -Historical Commission Meeting on January 15, 2008
Exhibit A — Site Plan Highlighting the Carriage House
Exhibit B — General Notes
Exhibit C — General Notes
Planning Commission Staff Report November 13, 2008
PLN2007-00062 Page 6 of 7
