LINKS BID 2 December 15, 2008 <br />Redevelopment Agency Support <br />• The West San Leandro/MacArthur Blvd. Redevelopment Project Area has contributed <br />between $56,000 to $83,000 annually to shuttle operations, with the exception of one year in <br />which support exceeded $200,000. <br />• Staff does not recommend continued funding of LINKS without business support for the <br />shuttle, exemplified by less than 50% of businesses protesting the creation of a new BID. <br />Process To Re-Establish the Bid For A Five Year Term Starting in FY 2009-10 <br />At the request of the SLTMO, the City Council must adopt a Resolution of Intention, declaring the <br />City's intention to re-establish the BID if the Council wishes to do so. Adoption of the ROI starts the <br />legally required notification and public hearing process to obtain input from the community as to the <br />merits of the proposed assessment. All of the businesses within the boundaries of the BID who pay <br />the assessment will be mailed a notice of the proposal to re-establish the BID within seven days after <br />the Council action on the ROI. <br />This notice will be mailed in a City of San Leandro envelope stamped "Public Notice" in red ink for <br />emphasis. The mailing will include an informational sheet that explains the following: <br />• the type of assessment, <br />• the affected parties, <br />• how the assessment would be collected, <br />• the purpose of the fee, <br />• the time and place for the required public hearing, and <br />• how to register a protest vote. <br />The mailing will also include: <br />• a copy of the ROI, as required by law, <br />• a map showing the shuttle route and the boundaries of the proposed BID, and <br />• aself-addressed postcard sized protest card, as a convenience to those business owners that <br />choose to register a protest. <br />All notices will be addressed directly to the affected business or "current business" to ensure the <br />most accurate noticing possible. In addition, for those businesses with a mailing address outside the <br />BID, a notice will be mailed to both the mailing address and the physical address within the shuttle <br />area. <br />At the conclusion of the Public Hearing, staff will provide an uncertified total of BID protest votes <br />and present this information to the City Council. If the combination of written protests and verbal <br />protests by business owners amount to more than 50% of the total assessments, the BID will fail and <br />cannot be re-established. Furthermore, no other attempt may be made to form the BID in the stated <br />area for a period of one year. <br />If the City receives protest ballots from less than 50% of the affected business owners, the Council <br />can at its discretion approve the ordinance and re-establish the BID. This could occur by the end of <br />March 2009 and take effect by May 2009. <br />Concurrent with adoption of the ordinance to re-establish the BID, the City and Redevelopment <br />Agency will need to enter into a new agreement with the SLTMO for the management and <br />administration of the West San Leandro Shuttle and Business Improvement District. <br />
