IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2008-145 (3145) <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO APPROVING <br />A COOPERATION AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND THE <br />REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO FOR THE PURPOSE OF <br />UNDERTAKING REDEVELOPMENT ACTIVITIES WTHIN THE ALAMEDA COUNTY- <br />CITY OF SAN LEANDRO REDEVELOPMENT PROJECT AREA AT A COST NOT TO <br />EXCEED $1,300,000 TO THE REDEVELOPMENT AGENCY <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost of the acquisition of property for the construction of public improvements <br />within the project area; and <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost to acquire the property needed for the construction of any building, facility, <br />structure, or other improvements that is publicly owned either within or without the project area <br />if it determines all of the following: <br />a. The improvements are of benefit to the project area or the immediate <br />neighborhood in which the project is located; and <br />b. That no other reasonable means of financing the acquisition of property and <br />relocation of the tenant at 14901 East 14th Street are available to the community; and <br />c. That the payment of funds for the acquisition will assist in the elimination of one <br />or more blighting conditions inside the project area; and <br />d. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />WHEREAS, the Redevelopment Agency ("Agency") has approved a "Cooperation <br />Agreement" attached as Exhibit "A" and incorporated herein between the Agency and the City, <br />the purpose of said Agreement being to allow the City and the Agency to work together on the <br />improvement of the East 14th Street/ Hesperian/150th Avenue Improvement project (the <br />"Project"); and <br />WHEREAS, the City desires to approve the afore-referenced Cooperation Agreement <br />between the Agency and the City whereby the Agency will provide funds for property <br />acquisition and tenant relocation for 14901 East 14th Street for the East 14th Street/Hesperian <br />Boulevard/150th Avenue Improvement project; and <br />
