WHEREAS, a portion of the private unpaved road known as Eden Road ("Property") is <br />currently in tax default with Alameda County, non-maintained, and a source of visual and <br />economic blight in the West San Leandro-MacArthur Boulevard Project Area in which it is <br />located; and <br />WHEREAS, Alameda County has agreed to work with the City to begin the process of <br />recapturing the property due to its default status, with the cost for the land being the cost of <br />unpaid taxes, publication and noticing charges, and an administrative fee, together not to exceed <br />$40,000.00, subject to the County's receipt of legislative approval by the City to acquire the <br />property; and <br />WHEREAS, the City's acquisition of the property will allow plaiming to begin to bring <br />the right-of--way up to City standards, which will be of direct benefit to the businesses and <br />residents in the Project Area; and <br />WHEREAS, acquiring Eden Road for public right-of--way was identified as a project in <br />the Five Year Implementation Plan far the Project Area and the cost of the right-of--way is an <br />eligible use of tax increment as well as the 2004 Tax Allocation Bonds sold in this project area; <br />and <br />WHEREAS, no other reasonable means of financing the purchase of the Property is <br />available to the community, in that the only other possible source of funding is through the use of <br />the City's General Fund and that is pledged for the provision of essential City services for the <br />residents of the City such as police and fire services; and <br />WHEREAS, the purchase of the Property will assist in the elimination of one or more <br />blighting conditions inside the Project Area by furthering the implementation of the Project Area <br />Redevelopment Plan, strengthening existing uses in the Project Area and providing alternate <br />RESOLUTION NO. 2004-016 RDA Z <br />
