WHEREAS, a portion of the private unpaved road known as Eden Road ("Property") is currently in tax default with Alameda County, non-maintained, and a source of visual and economic blight in the West San Leandro-MacArthur Boulevard Project Area in which it is located; and WHEREAS, Alameda County has agreed to work with the City to begin the process of recapturing the property due to its default status, with the cost for the land being the cost of unpaid taxes, publication and noticing charges, and an administrative fee, together not to exceed $40,000.00, subject to the County's receipt of legislative approval by the City to acquire the property; and WHEREAS, the City's acquisition of the property will allow plaiming to begin to bring the right-of--way up to City standards, which will be of direct benefit to the businesses and residents in the Project Area; and WHEREAS, acquiring Eden Road for public right-of--way was identified as a project in the Five Year Implementation Plan far the Project Area and the cost of the right-of--way is an eligible use of tax increment as well as the 2004 Tax Allocation Bonds sold in this project area; and WHEREAS, no other reasonable means of financing the purchase of the Property is available to the community, in that the only other possible source of funding is through the use of the City's General Fund and that is pledged for the provision of essential City services for the residents of the City such as police and fire services; and WHEREAS, the purchase of the Property will assist in the elimination of one or more blighting conditions inside the Project Area by furthering the implementation of the Project Area Redevelopment Plan, strengthening existing uses in the Project Area and providing alternate RESOLUTION NO. 2004-016 RDA Z
