Code27383) and Docume~atyFT~apsfer Tax (~2evenue,and -~ <br />Taxation Code ~ ] 1922). ~ ~ ~ ~ - <br />gale: l l69 <br />APN: 075-0005-Oll -O l <br />~~ ~~ `~a~Cl~ <br />GRANT DEED ~ ` , ~ "" _~ ~ ~ ~`E <br />THIS INDENTURE, made this 16thday of September, 2004, between EAST BAY MUNICIPAL <br />UTILITY DISTRICT, a public corporation, organized and existing under the laws of the State of California, <br />hereinafter called Grantor, and the REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO, a <br />public body, corporate and politic, of the State of California, hereinafter called Grantee, <br />WITNESSETH: <br />THAT the Grantor, for a good and valuable consideration, the receipt and sufficiency whereof are <br />hereby acknowledged, does hereby grant, bargain and sell, convey and confirm, to the Grantee and to the <br />Grantee's successors and assigns forever, all that certain real property at ] 595 Washington Avenue as <br />described in Exhibit "A" attached hereto and made a part hereof and hereinafter referred to as "property". <br />TOGETHER with all and singular the tenements, hereditaments and appurtenances thereunto <br />belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, <br />issues and profits thereof. <br />The Grantor is selling the properly in an "AS IS" physical condition and Grantee accepts this, with no <br />warranty, guarantee, representation or liability, express or implied on the part of the Grantor as to any matter, <br />including, but not limited to the physical condition and/or contents of and/or on the property, and/or the <br />condition and/or possible uses of the property or any improvements thereon, the condition of the soil or the <br />geology of the soil, the condition of the air, surface water or groundwater, the presence of lc~7own and <br />lmknown faults, the presence of any hazardous substance, materials, or other kinds of contamination or <br />pollutants of any kind in the air, soil, groundwater, building or the suitability of the property for the <br />construction and/or use of the improvements thereon. It shall be the sole responsibility of the Grantee, at its <br />sole cost and expense, to investigate and determine the suitability of the soil, water, geologic, environmental, <br />physical and seismic conditions of the property, for the intended use contemplated by Grantee, and to <br />determineaud comply with all building, plamling, zoning and other laws and regulations relative to the <br />property and the uses to which it can be put. Grantee relies solely on Grantee's own judgment, experience and <br />investigations as to the present and fixture condition of the property or its suitability for Grantee's intended use <br />and is not relying in any manner on any representation or warranty by Grantor.
