4. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") is <br />engaged in the Downtown Lighting and Pedestrian Improvements project in the City's <br />downtown area, including the Plaza Redevelopment Project Area ("Project Area"), which is <br />designed in part to draw people into that area; and <br />WHEREAS, as part of the implementation of the Downtown Lighting and Pedestrian <br />Improvements project, a storm drain and the footing for an entryway archway (the <br />"Improvements") need to be installed on a portion of the property located at 1267 Washington <br />Avenue in San Leandro, APN 075-0226-003 (the "Property"), which is owned by Regency <br />Centers LP ("Regency"); and <br />WHEREAS, the Property is located in the Project Area; and <br />WHEREAS, the Agency desires to further the implementation of the Downtown Lighting <br />and Pedestrian Improvements project by acquiring, with Redevelopment Agency funds, an <br />easement on, over and through the Property to allow for the installation, operation and <br />maintenance of the Improvements; and <br />WHEREAS, Regency has agreed to execute and deposit into escrow a Grant of Easement <br />and Right of Way ("Grant of Easement"), conveying the easement to the Agency; and <br />WHEREAS, the Agency also desires to contribute Redevelopment Agency funds for <br />installation of the Improvements on the Property; and <br />WHEREAS, in order for the Improvements to be installed on the Property, the Agency <br />needs to also acquire a Temporary Construction Easement on that portion of 1267 Washington <br />Avenue that is not included in the Grant of Easement; and <br />RESOLUTION NO. 2004-020 RDA 2 <br />
