The San Leandro City Council will hold a public hearing to take testimony <br />from all interested persons for or against re-establishment of the BID for a <br />term of five years, the area of the BID and the specific types of service, <br />improvements or activities planned. <br />A copy of the Resolution of Intention for re-establishment of the BID is enclosed. Following are answers to some frequently asked <br />questions about the BID. If you have additional questions, contact Elmer Penaranda, Office of Business Development, <br />epenaranda@ci.san-leandro.ca.us or (510) 577-3314. <br />• Type ofAssessment: Business Improvement District assessment levied only on businesses in the affected service area. <br />• Who the Fees Affect: Only those businesses within the boundaries of the established district (see copyofmap attached). <br />Businesses with five or fewer employees, property owners, home businesses, and nonprofit businesses are exempt from the fees. <br />• How the Assessment is Collected: The annual assessment is levied and collected each year in January as part of the Business License <br />Tax renewal process. The fee is levied on a fiscal year basis (i.e. July 1 toJune 30). The BID for new business licenses issued between <br />January 1 and June 30 is prorated 50%, while no BID is collected from businesses obtaining new business licenses during the period <br />of July 1 through December 31 (as the BID forJuly 1-June 30 is collected during [he Januaryrenewal process). <br />• Purpose: All fees collected from the assessment will partially fund the operation of the LINKS shuttle service to and from the <br />downtown San Leandro BART Station.The shuttle service will be a free service to riders. <br />• Amounts of the Proposed BIU Assessment: $25.00 Base Fee per year plus $10.88 per employee per year. The annual assessment <br />may be increased in an amount up to the increase, if any, of the Bay Area Cost of Living Index. <br />Under California law, assessment districts can only be formed through a type of vote called a protest vote. The vote is held amongst <br />all affected parties, and any party that does not wish the district to be formed must register its protest through a protest vote. <br />TO OFFICIALLY REGISTER YOUR PROTEST TO THE BtA: <br />1. CompleteTHEENCLOSED CARD. Card should be signed bythe registered business owner, Chief Executive Officer, Chief <br />Financial Officer or other Corporate Officer, authorized Member of the Board of Directors or authorized General Manager. <br />2. Affix postage and mail or hand deliver it to the City Clerk, City of San Leandro, 835 East 14th Street, San Leandro, CA 94577. <br />To be considered, all protests, whether mailed or hand delivered, must be received by the Ciry Clerk before the conclusion of the public <br />hearing scheduled for Monday, March 16, 2009 at 7:00 p.m. Written protests may also be presented in person at the Public Hearing. <br />Protests by business owners amounting to more than 50% of the total assessment will prohibit re-establishment of the proposed <br />Business Improvement District for the West San Leandro LINKS Shuttle. The current BID terminates on June 30, 2009. If the City, <br />however, receives protest ballots from less than 50% of the affected businesses, the City Council can, at its discretion, approve the <br />ordinance and re-establish the BID for a period of up to five years. Protest votes are weighted by the number of employees according <br />to the City's Business License records. For example, a protest vote from the owner of the XYZ Company having 20 employees will <br />count as 20 votes against the BID. <br />
