Summary Report of Health & Safety Code Findings -Ninth Grade Campus <br />Benefit to the Project Area <br />The 2004 South End Strategy adopted by the City Council in 2004 identifies the Palma <br />District on East 14th Street between San Leandro Boulevard and 141St Avenue as a proposed <br />vibrant center for the South Area. Completion of the Ninth Grade Campus and the related public <br />improvements will add vitality to the area as students, faculty and staff, and students' families <br />frequent the area. The new school will relieve overcrowding at San Leandro High School, <br />currently the City's only high school, and thus will provide enhanced educational benefits to all <br />City public high school students including those who reside within the Project Area. In addition <br />to enhancing opportunities for existing and new retail establishments in the area, completion of <br />the Project will complement other public facilities being constructed in the immediate area, <br />including the San Leandro High School Performing Arts Center and the Senior Community <br />Center. <br />In addition, pursuant to a proposed Joint Use Agreement with the District, Project Area <br />and other City residents will be entitled to use of the gymnasium for recreational purposes during <br />evenings, weekends, holidays and days during which school instructional classes are not being <br />conducted. <br />No Other Reasonable Means of Financin <br />The District has indicated that it has no other reasonable means of financing completion <br />of the gymnasium and related public improvements without assistance from the City and the <br />Agency. The budget constraints of the City are such that it has no general fund revenues which <br />are not already committed or required for the provision of essential services such as police and <br />fire services. The extraordinary voter approval requirements applicable to traditional methods of <br />fmancing (such as general obligation bonds and community facilities district special tax bonds), <br />as a practical matter prevent the City from financing the Project by such means. No moneys of <br />the City were, are or are reasonably expected to be available on a long-term basis for the Project. <br />In addition, assessment financing or special tax fmancing could overburden benefited properties, <br />and in addition, special taxes require atwo-thirds vote, and assessments are subject to a majority <br />protest. <br />Consistency with the A ency's Implementation Plan <br />In December 2004 the Agency adopted its current Five-Year Implementation Plan. The <br />Project is consistent with the following objectives as stated in the Plan: <br />• Assist City departments to implement projects consistent with the City's East 14th Street <br />South Area Plan. <br />• Upgrade the appearance of the Project Area visible to the public, so that it will be more <br />inviting to consumers and residents, stimulating increased sales and private investment in <br />the area. <br />• Implement streetscape-related recommendations of the East 14th Street South Area Plan, <br />including widening sidewalks. <br />3 <br />
