the provisions of this paragraph shall give City the right to <br />terminate this lease immediately. <br />Each and all of the provisions, agreements, terms, <br />covenants and conditions herein contained to be performed, <br />fulfilled, observed and kept shall be binding upon the heirs, <br />executors, administrators, successors and assigns of the <br />respective parties hereto, and all rights, privileges and <br />benefits arising under this lease and in favor of either party <br />shall be available in favor of the heirs, executors, <br />administrators, successors and assigns thereof respectively; <br />provided, that no assignment or subletting by or through Lessee <br />in violation of the provisions of this lease shall vest any <br />rights in any such assignment or lease, and, provided further <br />that City shall terminate this lease in the event of the demise <br />of lessee upon the written request of the Executor of Lessee's <br />estate and the satisfaction of all of Lessee's obligations <br />hereunder to the date of such request. <br />16. HAZARDOUS SUBSTANCES. <br />No goods, merchandise or material shall be kept, <br />stored or sold in or upon said premises which are in any way <br />explosive or hazardous; and no offensive or dangerous trade, <br />business or occupation shall be carried on therein or thereon; <br />and no machinery or apparatus shall be used or operated on said <br />premises which will in any way injure said premises or adjacent <br />facilities; provided, however, that nothing in this paragraph <br />contained shall preclude Lessee from bringing, keeping or using <br />on or about said premises and building such materials, supplies, <br />equipment and machinery as are necessary or customary, in <br />carrying on its said activities. <br />17. FORFEITURE. <br />A breach of any of the covenants or conditions of <br />this lease and agreement on the part of Lessee, such breach <br />continuing for a period of thirty (30) days after notice thereof <br />in writing, or abandonment of the use of the Premises by Lessee <br />for a period of sixty (60) days at any one time except when <br />prevented by fire, earthquake, wars, strikes, or other calamity <br />beyond its control, shall thereupon create a forfeiture of the <br />same and this lease and agreement shall thereupon at the option <br />of the City, without further notice, become null and void and <br />Lessee shall deliver up possession of said Premises within three <br />(3} months from date of notice of breach hereinbefore mentioned <br />(immediately in the case of an abandonment), and all rights and <br />interests of the Lessee under this lease shall cease and expire. <br />If, within said thirty (30) day period (sixty (60} days in case <br />of abandonment} Lessee in good faith commences to rectify any <br />such breach and thereafter with reasonable diligence does <br />March 19, 1991 7 <br />csl\a9ree\slbc.lse <br />
