CITY OF SAN LEANDRO <br />MEMORANDUM <br />DATE: February 4, 2009 <br />TO: Housing and Business Development Corn ee <br />FROM: Kathleen Livermore, Planning Manager ~~ <br />Community Development Department <br />BY: Philip Millenbah, Senior Planner <br />SUBJECT: Regulation of "Retail Box" Development <br />Staff is reviewing the zoning issues relative to regulating "retail box" development in San <br />Leandro and is proceeding in its review of the issue in the following way: <br />1) Staff will do a statewide review of other cities ordinances relative to regulating retail box <br />development. <br />2) Staff s early review of the subject seems to indicate that developing a "retail cap" <br />ordinance is the method of choice to many cities in CA. A retail cap ordinance limits <br />both the size of the structure and the percentage of floor area designated for the sale of <br />non-taxable goods. <br />3) Staff will review ordinances adopted by, Alameda, Oakland, Stockton, Tuolumne <br />County, Livermore, San Luis Obispo and Turlock-all cities with retail cap ordinances. <br />4) Because Turlock's ordinance was subject to extensive litigation with Walmart, staff will <br />look closely at their retail cap ordinance along with any supporting General Plan changes <br />and implementing procedures. <br />5) Staff will review the San Leandro's General Plan and suggest ways of amending the <br />General Plan that will support a new retail box zoning ordinance. Issues here would be <br />establishing policies that protect existing businesses, prevent commercial development on <br />the periphery of the city, and ensuring that all new commercial development is <br />compatible and consistent in size with the surrounding built environment. <br />6) Staff will prepare a draft ordinance and bring it to the Planning Commission by fall 2009., <br />7) Staff expects a final ordinance to be presented to the City Council by fall 2009. <br />
