2.3 Construction Standards. All work done in connection with construction <br />of the Project, including subsequent improvement, alteration or replacement, <br />shall be conducted in accordance with all applicable local, state and federal <br />statutes, codes, ordinances, laws and regulations (collectively, "Applicable <br />Laws"), including without limitation, California Labor Code Section 1720 et <br />seq., the Americans with Disabilities Act, all applicable competitive bidding <br />requirements, and all provisions of law applicable to school facilities, as and to <br />the extent applicable. School District shall have the responsibility for obtaining <br />all necessary governmental permits and approvals for the development of the <br />Project. <br />2.4 Equal Opportunity. During construction of the Project there shall be no <br />discrimination on the basis of race, religion, color, creed, religion, sex, sexual <br />orientation, marital status, ancestry or national origin in the hiring, firing, <br />promoting or demoting of any person engaged in construction of the Project. <br />School District shall direct its contractors and subcontractors to refrain from <br />discrimination on such basis. <br />ARTICLE III <br />MAINTENANCE, USE AND OPERATION <br />3.1 City Use of Gymnasium. City shall have the right to use the Gymnasium <br />in accordance with the Joint Use Agreement. <br />3.2 Maintenance. Except as may be otherwise provided in the Joint Use <br />Agreement, School District shall, at School District's sole cost and expense, <br />maintain and manage the Project in good order and repair and in neat, clean <br />sanitary and safe condition in compliance with all Applicable Laws. <br />3.3 Changes and Alterations. Without the consent of City, District shall not <br />demolish or undertake alterations to the Project that would diminish or <br />interfere with the exercise of City's rights under the Joint Use Agreement, nor <br />shall School District enter into any agreement, including without limitation any <br />agreement concerning the use, sale, lease or other conveyance of the Project or <br />part thereof that would diminish or interfere with the exercise of City's rights <br />under the Joint Use Agreement. <br />3.4 Obligation to Refrain from Discrimination. There shall be no <br />discrimination against or segregation of any person or group on account of any <br />basis listed in subdivision (a) or (d) of Section 12955 of the Government Cade, <br />as those bases are defined in Sections 12926, 12926.1, subdivision (m) and <br />paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the <br />Government Code in the leasing, subleasing, transferring, use, occupancy, <br />tenure or enjoyment of the Project, or any portion thereof, nor shall School <br />1187216.1 4 <br />
