State Law-There are no statewide restrictions requiring tobacco retailers to obtain a conditional use <br />permit. <br />Grade Criteria <br />1 bonus point-The city/county has adopted an ordinance that requires tobacco retailers to obtain a <br />conditional use permit in order to establish a business that sells tobacco within a certain distance of <br />schools, parks or other areas where children congregate. <br />Sale of Tobacco Products in Pharmacies <br />Description -Pharmacies are traditionally places where people go to purchase products to get healthy <br />or improve their health. The availability of tobacco products at pharmacies associates them with other <br />healthy products and with the general improving health focus of these stores. Many health <br />organizations believe that selling tobacco at pharmacies is contrary to a pharmacy's purpose and have <br />advocated voluntary policies or local ordinances to restrict tobacco sales at pharmacies. <br />State Law-There is no statewide law that restricts pharmacies from selling tobacco products. <br />Pharmacies that elect to sell tobacco products, like all other types of tobacco retailers, must obtain a <br />statewide tobacco retailer license. <br />Grade Criteria <br />1 bonus point-Tobacco products are prohibited from being sold at all pharmacies or at certain types of <br />pharmacies in the city/county. <br />Sampling of Tobacco Products <br />Descriptian -Giving away free tobacco products or providing these products at a reduced cost is a toot <br />that tobacco companies use to gain new customers and get current customers addicted to new types of <br />products. Restricting this sampling can make it harder for tobacco companies to addict new users and <br />can help to reduce prevalence rates for using tobacco products. <br />State Law- State law prohibits the free or nominal-cost distribution of cigarettes or smokeless tobacco <br />products on public grounds or private grounds open to the public. This law includes coupons, coupon <br />offers, rebate offers, gift certificates/cards and other similar offers in this prohibition. Through the <br />Master Settlement Agreement, the settling tobacco companies are prohibited from providing free <br />samples of their products except in an adult-only facility. State law also prohibits free samples of <br />smokeless tobacco products within atwo-block radius of any facility primarily directed at people under <br />the age of 18. <br />Grade Criteria <br />1 bonus point-The city/county has adopted an ordinance that restricts the free ornominal-cost <br />distribution of tobacco products beyond the restrictions in state law, such as prohibiting the free <br />distribution oftobacco products entirely. <br />t~VERALL T(~BACCCJ Ct'~~tTRC)L G~iB~~3~ <br />Description -The Overall Tobacco Control grade is a letter grade awarded to the jurisdiction based on its <br />grades in the three categories. This year, the overall grade is optional and the decision to calculate and <br />award this grade to a city is made by local lung association staff. <br />Grade Criteria -To obtain the Tobacco Control grade, the city or county is given point values for each of <br />its grades in the three categories (Smokefree Outdoor Air, Smokefree Housing, Reducing Sales of <br />Tobacco Products) as follows -A=4; B=3; C=2; D=1; and F=O.
