San Leandro Municipal Code Sections Related to Smoking not covered in <br />State Law <br />4-12-510 DISCRETION OF OWNER/OPERATOR. <br />Notwithstanding any other provision of this Chapter, any owner, operator, manager or <br />other person who controls any establishment described in this Article may designate that entire <br />establishment as a nonsmoking establishment. <br />4-12-700 SIGNS. <br />(a) The owner or other person having the authority to manage and control any area, <br />other than a restaurant, designated as a no-smoking area pursuant to this Chapter shall post or <br />cause to be posted and prominently displayed, and shall maintain, "No Smoking" signs in <br />conspicuous locations within such areas. Such signs shall clearly and conspicuously recite the <br />phrase "No Smoking" with letters not less than one (1) inch in height and/or the international no- <br />srnoking symbol and shall cite the Municipal Code. Signs shall be of sufficient number and <br />prominent location to convey the message clearly and legibly. <br />4-12-900 ENFORCEMENT. <br />(a) The owner or other person having the authority to manage and control any public <br />place or place of employment, or a designated agent of such owner or manager, shall inform <br />persons smoking in restricted areas that they are in violation of the law. <br />(b) The City Manager shall enforce the civil provisions of this Article. The Police <br />Department shall undertake all criminal enforcement. <br />
