12. Applicant shall either dedicate pazkland, pay pazk in lieu fees, or a combination of <br />both as required by the San Leandro Municipal Code. The pazk in lieu fee for the <br />proposed 100 unit building on lot 2 is $1,036,813. This fee will be reduced by the <br />ratio of supplied pazk azea to required park area (33,872 sf per Municipal Code). <br />The supplied park area shall be credited as follows: 100% of azea that is public open <br />space, 50% of azea that is private open space with usage intensity similaz to public <br />parks, 25% of area that is private open space with usage intensity less than public <br />pazks. This fee is due when the building permit is issued. Fees for buildings and <br />credit for open space on the other lots will be determined when permits are issued <br />for those lots. <br />13. Applicant shall pay the Development Fee for Street Improvements (DFSI) prior to <br />issuance of a building permit. The standazd DFSI is $1,106.43/unit for multi-unit <br />development; however, this project is located within '/4 mile of a BART station and <br />it provides no more than one (1) parking space per unit. Per the downtown TOD <br />EIR this type of development generates 60% of the traffic created by a traditional <br />multi-unit project so the fee is reduced by 40% to $663.86/unit for the proposed 100 <br />unit building on lot 2. This fee is due when the building permit is issued. Fees for <br />buildings on the other lots will be determined when permits aze issued far those lots. <br />14. Applicant shall pay the project's fair shaze of the traffic impact fees for the I- <br />880/Mazina interchange improvement project prior to issuance of a building permit. <br />The fee has not_ yet been adopted by Council but will be on the order of $2,060/unit <br />far multi-uzut development; however, this project is located within '/4 mile of a <br />BART station and it provides no more than one (1) pazking space per unit. Per the <br />downtown TOD EIR this type of development generates 60% of the traffic created <br />by a traditional multi-unit project so the fee is reduced by 40% to approximately <br />$1,236.00/unit for the proposed 100 unit building on lot 2. This fee is due when the <br />building permit is issued. Fees for buildings on the other lots will be determined <br />when permits aze issued for those lots. <br />15. The proposed development shall comply with City ordinances, policies and <br />regulations. All public and private site improvements shall be in accordance with <br />the City's Design Standards, Specifications and Standard Plans unless otherwise <br />specifically approved by the City Engineer. <br />16. Applicant shall have public and private site improvements designed and stamped by <br />a civil engineer registered to practice within the State of California. Applicant shall <br />obtain approval of the City Engineer for all on and off site improvements prior to <br />the issuance of Building Permits for the project. All improvements within the right <br />of way shall be per City Standazds. Improvements shall be designed so that storm <br />water does nat impact pedestrian travel along sidewalks or across streets. <br />17. Applicant shall either demonstrate the adequacy of the existing storm drain system <br />to handle the existing run-off from the drainage basin aswell asrun-off from the <br />project, upgrade the system to handle said flow, or meter run-off from the site so <br />that peak flows in the system do not change. <br />Vesting Tentative Map 8010/ PLN2008-00054 Page 4 <br />Conditions of Approval March 2, 2009 <br />
