Hollister <br />City Manager <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />AN ORDINANCE AMENDING SECTION 4-5-205(F~ OF THE SAN LEANDRO <br />MUNICIPAL CODE RELATING TO PEDDLERS, SOLICITORS AND <br />ITINERANT MERCHANTS <br />SUMMARY AND RECOMMENDATION <br />Staff members from the Police and Finance Departments met to discuss proposed <br />changes to Chapter 4-5, Title 4 of the San Leandro Municipal Code, commonly known as <br />"Peddlers, Solicitors, and Itinerant Merchants." The proposed revision would require that <br />all applicants for peddler/solicitor permits submit fingerprints for the initial application <br />and for renewals in every even numbered year thereafter. <br />The amended ordinance has been reviewed and approved by the City Attorney. The <br />proposed revision to Chapter 4-5, Title 4 of the San Leandro Municipal Code addresses <br />the need to improve accountability and enhance the safety of our citizenry. Therefore, it <br />is recommended that the City Council approve the amended Ordinance. <br />BACKGROUND <br />Peddlers, solicitors, and itinerant merchants have historically operated independently, <br />freely able to work virtually anywhere within the community. Over the past several <br />years, several applicants have been denied permits due to their criminal convictions, <br />including embezzlement, drug dealing, and pimping. One applicant failed to disclose her <br />arrest for embezzlement and conviction for grand theft on her application. This omission <br />was caught when her fingerprints were returned from the Department of Justice. <br />Incidents such as these brought discussions of community protection to the forefront <br />regarding the City's ability to monitor this type of business. Section 4-5-205 as written <br />allows applicants to submit fingerprints one time only for screening, and to subsequently <br />
