renew their permits indefinitely with no additional criminal history audits. By state law,
members of the Police Department cannot use available computer systems to run
inquiries about the criminal history status of applicants. This may only be done by
submitting fingerprints to the Department of Justice. Unlike other employment
certifications (teachers, police officers, coaches), where public agencies are required to
notify employers of certain types of arrests (drugs, moral turpitude, etc), there are no laws
requiring the reporting of crimes committed by peddlers or solicitors, who are self-
employed. They are under no obligation to disclose their permit status to an arresting
criminal justice agency.
Current City Council Policy
Chapter 4-5, Title 4 of the San Leandro Municipal Code.
Previous City Council Action(s)
Not Applicable.
City Council Committee Review and Action
Not Applicable.
Applicable General Plan Policy
Not Applicable.
Permits and/or Variances Granted
Not Applicable.
Environmental Review
Not Applicable.
Code Compliance Review
Not Applicable.
Board/Commission Findings
Not Applicable.
Summary Of Public Outreach Efforts
Not Applicable.
Fiscal Impact
Live Scan fingerprinting offered by the Police Department currently costs
applicants $57.00 ($32.00 for Live Scan and a $25.00 administrative fee charged
by the Police Department). If adopted, this amendment would add $57.00 to the
cost of renewing apeddler/solicitor permit every other year, or an average cost of
$28.50 per year per peddler/solicitor permit. There are currently approximately
50 peddler permits issued by the City.
