CONDITIONS OF APPROVAL <br />PLN2008-00025 <br />395-B MacArthur <br />Universal Auto Sales, LLC (Applicants) <br />HSR, LLC (Property Owners) <br />I. INTENT <br />The intent of this approval is to allow the subject premises to be used only for the <br />delivery of vehicles sold over the Internet. The intent is to NOT allow the subject <br />premises to be used for "vehiclelheavy equipment dealers, new or used", pursuant <br />to Article 6, section 2-6Q5 "CC District- Permitted Uses" or "Conditionally <br />Permitted Uses". <br />IL COMPLIANCE WITH APPROVED PLANS <br />A. The property owner shall comply with attached Exhibits A and B except as <br />hereinafter modified. (Copies are on file in the Community Development <br />Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A -Photographs of Property <br />Exhibit B -Site Plan <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is informed <br />of its terms and conditions. <br />III. PERMITTED USE <br />B. This administrative review permit is to allow an office for taking and receiving <br />delivery of vehicle retail Internet sales of used cars and two (2) off-street parking <br />spaces. Vehicles will be delivered to and received at the site by appointment only <br />at 395-B Macarthur. Any change or addition to the operation of taking and <br />transferring delivery of vehicle retail Internet sales of used cars, including <br />increase in office space or additional vehicle delivery holding space, shall be <br />subject to the review of the Zoning Enforcement Official who may approve or <br />deny the request administratively. <br />C. This permit is specific to Universal Auto Sales, LLC and is not transferable to <br />another DMV licensed Vehicle Retail Sales dealer or other successor in interest. <br />D. Any modification to the use or number of vehicle delivery holding spaces shall be <br />subject to the review and approval of the Zoning Enforcement Official who may <br />approve the request administratively. <br />Agreement to Conditions ~ October 9, 2008 <br />PLN2008-00025 Page 3 of 4 <br />
