2. A monument sign in the landscaped setback, indicated on Sheet Al <br />(Exhibit A), with colors, materials and finishes to match or compliment <br />the exterior materials of the proposed new building. The freestanding <br />sign shall maintain a minimum setback from the back of sidewalk ofone- <br />halftimes the overall height of the freestanding sign. <br />3. The placement of the freestanding sign shall comply with the <br />requirements of Zoning Code Section 4-1728 -Driveway Visibility. <br />B. In accordance with Section 4-1806 K of the Zoning Code, banners, balloons, <br />etc. are not permitted except for special events and grand openings and with <br />prior approval by the Zoning Enforcement Official. <br />V. ENGINEERING & TRANSPORATION <br />A. A reciprocal driveway easement will need to be prepared for the 40-foot wide <br />driveway straddling the property line with 1951 Fairway to the east. A <br />separate easement is also needed for the rolling gate at said driveway. <br />B. There is a set of railroad tracks running from Fairway Drive near the <br />southernmost corner of this property to the existing building on this parcel. <br />These tracks do not appear to be in use, since an onsite chain link fence <br />intersects it at various locations. Since these tracks are to be removed, any <br />existing railroad easement centered on these tracks should be considered for <br />abandonment. <br />C. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically <br />approved by the City Engineer. <br />D. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), <br />the City HEREBY NOTIFIES the applicant for this Project that the 90-day <br />approval period (in which the applicant may protest the imposition of any fees, <br />dedications, reservations, or other exactions imposed on this Project by these <br />Conditions of Approval) will begin on the date of the conditional approval of <br />this Project. If you fail to file a protest within this 90-day period, complying <br />with all of the requirements of Government Code Section 66020, you will be <br />legally barred from later challenging any such fees, dedications, reservations or <br />other exactions. <br />E. Applicant shall pay design review fees, development impact fees, permit fees, <br />inspection fees, and any other fees charged by the City or other reviewing <br />agencies for the review, approval, permitting and inspection of the public <br />and/or private improvements. <br />F. Site Improvement Plans for all on-site and off-site improvements shall be <br />approved by the City Engineer prior to the issuance of Building Permits for the <br />PLN2007-00028 May 20, 2008 <br />Conditions of Approval Page 5 of 10 <br />
